TITLE: Ordinance No. 2020-02, Second Reading, Amending the Code of the City of North Port, Chapter 78 - Utilities, Article V - Cross-Connection Control, Section 129 - Cross-Connection Control Program.

Second Reading: Approve Ordinance as presented

Background Information

At the October 3, 2019 special meeting, City Commission directed staff to draft an Ordinance amending City Code Section 78-129 - Cross-Connection Control Program, to remove reference to the "Opt-in" Program, which requires the City to provide residential property owners the ability to appoint the City as the property owner's agent for the purposes of completing the testing, installation, repair, and replacement requirements of the Cross-Connection Control Program. Staff drafted the Ordinance as directed and submitted a request to the City Attorney's Office to review the proposed changes. Upon review of the draft Ordinance, the City Attorney's Office recommended additional, unrelated revisions to Section 78-129 of the City Code be made in addition to the elimination of the "Opt-in" program. This Ordinance No. 2020-02, presented for first reading, includes all relevant and recommended amendments to the Code of the City of North Port, Section 78-129.

The Ordinance has been reviewed by legal to form and correctness.

Financial Impact

The following revenues and expenditures have been budgeted for FY19-20 in the accounts listed below for the residential "Opt-in" program.
