Recommended Action

 

Approve Resolution No. 2022-R-34 as presented.

 

Background Information

 

On December 7, 2021, NX North Port Owner, LLC, executed and recorded a permanent utility easement over a portion of the property identified as Sarasota County parcel identification number 0979-11-0001. This grants North Port Utilities access to the property for maintenance and operation of the collection and distribution system located within those easement areas. Typically, these easements would be recorded with the plat.   However, the plat for the entire Heron Creek area was recorded prior to the development of this area.   As such, the adoption of Resolution No. 2022-R-34, accepting the permanent utility easement by the Commission would be necessary.  

 

Resolution No. 2022-R-34 has been reviewed by the City Attorney and is legally correct as to form.
