TITLE: Approve the Ratification of Emergency Orders No. 2022-12 Relating to the Waiver of Permits and Fees for Certain Fences on Residential Property; 2022-13 Relating to the Waiver of Permits and Fees for Certain Sheds on Residential Property; 2022-14 Relating to the Temporary Use of Storage Containers on Residential Property; and 2022-15 Relating to Tree Protection Regulations.


Recommended Action

Approve the ratification of Emergency Orders No. 2022-12 Relating to the Waiver of Permits and Fees for Certain Fences on Residential Property; 2022-13 Relating to the Waiver of Permits and Fees for Certain Sheds on Residential Property; 2022-14 Relating to the Temporary Use of Storage Containers on Residential Property; and 2022-15 Relating to Tree Protection Regulations.

Background Information

On September 23, 2022, Florida Governor Ron DeSantis issued Executive Order Number 22-218, declaring a that a state of emergency exists in 24 Florida counties to include Sarasota County due to Tropical Depression Number Nine. On September 24, 2022, Governor DeSantis issued Executive Order 22-219 Amending Executive Order 22-218 to expanding the state of emergency to the State of Florida.

Subsequently on September 26, 2022, the Commission of the City of North Port met during an Emergency Meeting and adopted Ordinance 2022-30, declaring a local state of emergency in the City of North Port, granting emergency authority to the City Manager to issue Emergency Orders to ensure the safe conduct of necessary operations of the North Port City Government. The emergency authority granted to the City Manager during this state of emergency may extend beyond normal non-emergency powers. As the following Emergency Orders extend beyond his normal scope of authority, the City Manager requests that they be ratified by the City Commission:
