Recommended Action
Approve the Tenth Amendment to Construction Manager at Risk Contract No. 2023-17.001 for Construction Services Contract, Phase II with Wharton Smith, Inc. in the amount of $32,699, for Hurricane Ian Repairs at the Garden of the Five Senses.
Background Information
As a result of impacts from Hurricane Ian, the Garden of the Five Senses suffered damage to the sidewalks, park signage, and playground area as outlined in the Halliwell Construction Services, and Rostan Damage Assessment Reports.

> July 18, 2024: Wharton Smith, Inc. submitted a GMP proposal. This Amendment to Contract No. 2023-17.001 presented for approval is for the Construction Phase (Phase II) of the process. The Project Manager with the Department of Public Works provided a direct selection of Wharton Smith, Inc. as the preferred CMaR to carry out the project at the Garden of the Five Senses, and requests approval of this Amendment to proceed to construction.
