Recommended Action

 

Option 1: Approve the Water and Wastewater System Standard Developer’s Agreement by and between the City of North Port and Sunexus Rent Core Plus LLLP.

 

City Commission Options

 

Option 1: Approve the Water and Wastewater System Standard Developer’s Agreement by and between the City of North Port and Sunexus Rent Core Plus LLLP.

 

                     Pros: Allows the project to proceed with established terms for water and wastewater service. Ensures Equivalent Residential Connection (ERC) assignments; capacity payments; and infrastructure requirements are clearly documented.

                     Cons: Sets rigid timelines and conveys ERCs that may limit the City’s ability to address changes in demand.

 

Option 2: Deny the Water and Wastewater System Standard Developer’s Agreement by and between the City of North Port and Sunexus Rent Core Plus LLLP.

 

                     Pros: Denial avoids an obligation from the City to provide ERCs.

                     Cons: May delay project timelines, delay utility improvements needed for construction of development, and reduce associated revenue.

 

Background Information

 

The City of North Port utilizes a Standard Water and Wastewater Developer’s Agreement to establish the terms for providing utility service to new developments. Recently it has been determined that the standard agreement required updates to meet current code and now each agreement will require City Commission approval under City Code.

 

Sunexus Rent Core Plus LLLP is developing a property located off Sumter Boulevard and East Adina Circle. The agreement includes provisions for the design, permitting, and construction of water and wastewater infrastructure, including a water main, wastewater lift station and force main at the Developer’s expense. The onsite utility extension will connect to the City’s existing infrastructure, and the Developer will utilize 48 water and wastewater ERCs. The Developer will also dedicate necessary easements and transfer ownership of completed facilities to the city.

 

The Water and Wastewater System Standard Developer’s Agreement by and between the City of North Port and Sunexus Rent Core Plus LLLP has been reviewed by the City Attorney’s office and has been approved to form and correctness.

 

The Water and Wastewater System Standard Developer’s Agreement by and between the City of North Port and Sunexus Rent Core Plus LLLP was been provided to the City Clerk’s office on March 2, 2026, for signatures, subject to City Commission approval.

Approval of this agreement will result in the collection of water and wastewater capacity fees, inspection fees, and other applicable charges in accordance with the City’s adopted utility rate structure.
