Recommended Action

 

Option 1: Approve Ordinance No. 2026-08 as presented on first reading and continue to second reading on April 21, 2026.

Option 1: Approve Ordinance No. 2026-08 as presented on first reading and continue to second reading on April 21, 2026.

 

                     Pros: Approval of Ordinance No. 2026-08 fulfills statutory requirement for annual review and update of the capital improvements schedule of the Capital Improvements Element (CIE) of the Comprehensive Plan for consistency with the City’s adopted levels-of-service standards for public facilities.

                     Cons: There is no identifiable disadvantage to approval of Ordinance No. 2026-08.

 

Option 2: Deny Ordinance No. 2026-08.

 

                     Pros: There is no identifiable advantage to denial of Ordinance No. 2026-08.

                     Cons: Denial of Ordinance No. 2026-08 constitutes persistence of statutory non-compliance. Deferring annual review and update of the capital improvements schedule of the Capital Improvements Element (CIE) of the Comprehensive Plan, perpetuates inconsistency with the City’s adopted levels of service standards for public facilities.

 

Background Information

 

CIE Table 10-1 Five-Year Schedule of Capital Improvement Components within the Capital Improvements Element (CIE) of the Comprehensive Plan, identifies the City’s capital projects necessary for implementation and maintenance of the Level of Service (LOS) standards adopted in the Comprehensive Plan. Florida Statutes Section 163.3177(3)(b) requires local governments to review and update the CIE of the Comprehensive Plan on an annual basis.

 

Ordinance No. 2026-08 updates funding figures for each public facility type contained within CIE Table 10-1 based on the Fiscal Year 2026 - 2030 Capital Improvements Program adopted by the City Commission on September 18, 2025. The proposed ordinance also revises CIE Policy 5.3. adopting by reference the Sarasota Couty School District 2024-2025 Five-Year District Facilities Work Plan, adopted on January 14, 2025, by the Sarasota County School Board as required by the Capital Improvements Element, Policy 5.3 of the City’s Comprehensive Plan and the Interlocal Agreement with the Sarasota County School Board.

 

Florida Statutes Section 163.3177(3)(b) enables modifications to the capital improvements schedule without a text amendment to the Comprehensive Plan by means of adoption of an ordinance.

 

Ordinance No. 2026-08 has been reviewed by the City Attorney and is legally correct as to form.
