TITLE:                     Ordinance No. 2018-34, second reading, amending the Code of the City of North Port, Chapter 78, Utilities, Article V, Cross-Connection Control, Sections 78-125, 78-127, 78-129, 78-130, 78-132.

 

 

Recommended Action

 

Approve second reading of Ordinance No. 2018-34, amending the Code of the City of North Port, Chapter 78, Utilities, Article V, Cross-Connection Control, Sections 78-125, 78-127, 78-129, 78-130, 78-132.

 

Background Information

 

At the October 5, 2017 Commission meeting, North Port City Commission directed staff to investigate and bring back for consideration changes to the City’s Cross-Connection Control Ordinance, making the City’s requirements more consistent with changes to Rule 62-555.360, Florida Administrative Code.  Per Commission direction, staff has worked with Legal to draft Ordinance No. 2018-34, amending the City’s Cross-Connection Control Ordinance to allow non-testable dual check devices for residential properties without high degree of cross-connection hazard and incorporate biennial testing for testable devices for residential properties. 

 

At the first reading of Ordinance 2018-34, Commission directed staff to make the following revisions:

 

                     Change the word may to shall in 78-129 paragraph 5(c) and 5(e);

                     Correct a scrivener’s error in the last sentence of 78-129 paragraph 4(a);

                     Revise non-compliance disconnection language in 78-130 paragraph 1 and 78-129 paragraph 4(c), 6(d), 7(e),

                     Revise 78-129 paragraph 6(d) to clarify language pertaining to opt-in customers

                     Correct all residential annual testing references to biennial

                     Revise references to disconnection service charges to make fee name consistent with City Fee Schedule

 

Accordingly, staff presents Ordinance No. 2018-34 for Commission consideration and recommends approval of second reading.
