Background Information
Kenrick Gallander of RWA, INC, an agent on behalf of Deluxeton North Port LLC, has submitted a Rezone application to the City of North Port to Rezone a ± 55.02-acre portion of PID 1091-00-1000 currently zoned No Zoning Designation (“NZD”) to Industrial/Light Warehouse (“ILW”).
The properties to the north are located outside the City, under the jurisdiction of Sarasota County. These parcels have a zoning designation of Open Use Agricultural. Certain properties to the east and west are within the City of North Port and have a zoning designation of Agricultural and properties to the east and south have a zoning designation of Village.
This Petition has a companion application, a Future Land Use (FLU) Map Amendment (CPAL-22-247) to change the FLU designation for the parent parcel PID 1091-00-1000 to “Industrial” and “High Density Residential” scheduled to be heard prior to this rezoning on the same meeting date.
The subject property cannot be developed until it has a zoning designation.
Petition No. REZ-22-237, Toledo Blade 320 (Ordinance No. 2023-26) was heard by the Planning and Zoning Advisory Board (PZAB) during their Regular Meeting held on September 7, 2023. At the conclusion of their discussion, the PZAB with a vote of 4-2, recommended approval to the City Commission of Ordinance No. 2023-26, contingent upon approval of Petition No. CPAL-22-247 by the City Commission.
Ordinance No. 2023-26 has been reviewed by the City Attorney and is legally correct as to form.

The City Commission heard this item at their September 26, 2023, meeting and voted 3-2 to continue Ordinance No. 2023-26 to second reading on a date to be determined for approval.
Pursuant to Florida Statutes Section 166.041(4)(c), a business impact estimate was not required because this ordinance is enacted to implement Part II of Florida Statutes Chapter 163, relating to growth policy, county and municipal planning, and land development regulation, including zoning, development orders, development agreements, and development permits.
