Recommended Action

 

Option 1:  Approve the Fourth Amendment to Agreement No. 2017-40, Professional Design & Engineering Services for Warm Mineral Springs Park Master Plan by and between the City of North Port, Florida, and Kimley-Horn and Associates, Inc. to include additional scope related to the bridge design and environmental permitting to facilitate a trail connection from Warm Mineral Springs Park, 12200 San Servando Avenue, North Port, Florida 34287, to the North Port Connector of the Legacy Trail in the amount of $93,800 for a total contract amount of $786,600.

                     Pros:

o                     Supports continued progress on construction plans necessary for the trail connection from Warm Mineral Springs Park to the North Port Connector of the Legacy Trail.

o                     Helps maintain project momentum, improving the City’s readiness for future grant opportunities.

                     Cons: Utilizes Park Impact Fee funds that could otherwise be allocated to other park projects.

 

Option 2: Deny the Fourth Amendment to Agreement No. 2017-40, Professional Design & Engineering Services for Warm Mineral Springs Park Master Plan by and between the City of North Port, Florida, and Kimley-Horn and Associates, Inc. to include additional scope related to the bridge design and environmental permitting to facilitate a trail connection from Warm Mineral Springs Park, 12200 San Servando Avenue, North Port, Florida 34287, to the North Port Connector of the Legacy Trail in the amount of $93,800 for a total contract amount of $786,600.

 

                     Pros: Park Impact Fee funds remain available for other park projects.

                     Cons:

o                     Halts construction plan development, placing the project on hold until sufficient funding is appropriated.

o                     May jeopardize competitiveness or eligibility for grant funding if the required construction documents are delayed or incomplete.

o                     Interrupts coordination with external agencies potentially affecting schedules, investment and long term planning efforts.

 

Background Information

 

The Fourth Amendment further updates the City’s existing Professional Design and Engineering Services Agreement with Kimley Horn for the Warm Mineral Springs Park Master Plan. The amendment incorporates additional scope related to the trailhead and trail connection, specifically adding bridge engineering services and environmental permitting tasks. The amendment also revises the corresponding fee schedule and project timeline to support completion of this added work.

 

The following provides a chronological order of City Commission actions associated with Agreement No. 2017-40, Professional Design and Engineering Services for the Warm Mineral Springs Park Master Plan:

 

Ø                     April 5, 2018:  During the City Commission Special Meeting, Agreement No. 2017-40, Professional Design and Engineering Services for the Warm Mineral Springs Park Master Plan with Kimley-Horn and Associates was approved for the development of a Master Plan document for Warm Mineral Springs Park and associated improvements within the 80-acre site.

 

Ø                     February 25, 2020: During the City Commission Regular Meeting, the First Amendment to Agreement No. 2017-40 for Professional Design and Engineering Services for Warm Mineral Springs Park Master Plan with Kimley-Horn and Associates, Inc. was approved to develop construction and permitting documents for historic restoration of the existing buildings and utility infrastructure improvements.

 

Ø                     January 28, 2025: During the City Commission Regular Meeting, Ordinance No. 2025-01 was approved on second reading amending the non-district budget and capital improvement budget for fiscal year 2024-2025. Included in Ordinance No. 2025-01 was $500,000 in Park Impact Fee funding to support Capital Improvement Project No. P24LTC Legacy Trail Connection to Warm Mineral Springs.

 

Ø                     February 25, 2025: During the City Commission Regular Meeting, the Second Amendment to Agreement No. 2017-40 for Professional Design and Engineering Services for Warm Mineral Springs Park Master Plan with Kimley-Horn and Associates, Inc. was approved to facilitate a hybrid renovation of the historic buildings and utility infrastructure improvements.

 

Ø                     April 8, 2025: During the City Commission Regular Meeting, the Third Amendment to Agreement No. 2017-40, Professional Design and Engineering Services for Warm Mineral Springs Park Master Plan was approved specific to development of the construction documents for a trailhead and trail connection from Warm Mineral Springs Park to the North Port Connector of the Legacy Trail at Calera Street and West Price Boulevard.  This project has garnered support from key organizations such as the Gulf Coast Community Foundation, Trust for Public Lands, and Friends of the Legacy Trail. Furthermore, the Sarasota-Manatee Metropolitan Planning Organization has identified this trail connection as a priority project within the Sun Trail network for the region. Completing the design and having a shovel-ready project significantly enhances eligibility for construction grant opportunities. To that end, staff from the Parks & Recreation Department and the Grants Division have submitted construction grant applications to the federally funded Recreational Trails Program, in the amount of $450,000 and the state funded Sun Trail Grant Program, in the amount of $3,730,000. This application was approved by the City Commission during the City Commission Regular Meeting held on February 11, 2025.

 

Ø                     May 5, 2026: During the City Commission Regular Meeting, Ordinance No. 2026-14 was approved on second reading amending the non-district budget and capital improvement budget for fiscal year 2025-2026 to increase Park Impact Fee funded project P24LTC, Legacy Trail Connection to Warm Mineral Springs Park, in the amount of $125,000.

 

The Fourth Amendment to Agreement No. 2017-40, Professional Design & Engineering Services for Warm Mineral Springs Park Master Plan by and between the City of North Port, Florida, and Kimley-Horn and Associates, Inc. to include additional scope related to the bridge design and environmental permitting to facilitate a trail connection from Warm Mineral Springs Park, 12200 San Servando Avenue, North Port, Florida 34287, to the North Port Connector of the Legacy Trail in the amount of $93,800 for a total contract amount of $786,600.has been reviewed by the City Attorney and is legally correct as to form.

 

The Fourth Amendment to Agreement No. 2017-40, Professional Design & Engineering Services for Warm Mineral Springs Park Master Plan by and between the City of North Port, Florida, and Kimley-Horn and Associates, Inc. to include additional scope related to the bridge design and environmental permitting to facilitate a trail connection from Warm Mineral Springs Park, 12200 San Servando Avenue, North Port, Florida 34287, to the North Port Connector of the Legacy Trail in the amount of $93,800 for a total contract amount of $786,600 was provided to the City Clerk’s Office on May 18, 2026 for signature, subject to City Commission approval.
