Recommended Action

 

Option 1: Approve the Annual Certification Statement between Florida Highway Safety and Motor Vehicles and City of North Port regarding access to the Driver and Vehicle Information Database.

 

City Commission Options

 

Option 1: Approve the Annual Certification Statement between Florida Highway Safety and Motor Vehicles and City of North Port regarding access to the Driver and Vehicle Information Database (DAVID).

 

                     Pros: The Police Department will be able to continue to use this resource to obtain driver license information.

                     Cons: The Police Department would be out of compliance with the Agreement and risk losing access to the DAVID system.

 

Option 2: Deny the Annual Certification Statement between Florida Highway Safety and Motor Vehicles and City of North Port regarding access to the Driver and Vehicle Information Database (DAVID).

 

                     Pros:  There are no foreseeable pros to denying this certification statement.

                     Cons: If the certification is denied, the Police Department would be out of compliance with the Agreement and risk losing access to the DAVID system.

 

Background Information

 

The City of North Port currently has a Memorandum of Understanding with the Florida Highway Safety and Motor Vehicles, which grants the Police Department access to the Driver and Vehicle Information Database (DAVID). The Annual Certification Statement affirms that the requesting party has evaluated its procedures and has implemented adequate controls to protect personal data from unauthorized access, distribution, use, modification, or disclosure. Furthermore, it confirms that the Requesting Party is in full compliance with the requirements set forth in Contractual Agreement HSMV-0197-23.
