TITLE: A Resolution of the City Commission of the City of North Port, Florida, Accepting a Non-Exclusive Access and Utility Easement on Portions of a Tract of Land Located in Section 21, Township 39 South, Range 21 East, Sarasota County, Florida, and a Portion of Lot 19 of Heron Creek Place Phase 2, Bearing Sarasota County Property Appraiser Parcel Identification Number 0978010011; Providing for Incorporation of Recitals; Providing for Filing of Documents; Providing for Conflicts; Providing for Severability; and Providing an Effective Date.

Background Information
North Port MF Ventures, LLC, the owner of parcel 0987010011, desires to grant to the City of North Port a non-exclusive access and utility easement over and across certain portions of properties owned by North Port MF Ventures, LLC in connection to the infrastructure installed within the Heron Creek Place Phase 2 development.
The easement grants the City access to the property for installation, maintenance, repair and use of the water main, wastewater main, irrigation main, and facilities related to the infrastructure installed on the property, whether above or below ground level. The plat of the parcel was done prior to the installation of the infrastructure; therefore, this easement is necessary now that the water and wastewater infrastructure has been installed and will be dedicated to the City of North Port for maintenance and use.
Resolution No. 2025-R-22 has been reviewed by the Interim City Attorney and is legally correct as to form.
