Recommended Action

 

Approve Resolution No. 2025-R-22 as presented.

 

Background Information

 

North Port MF Ventures, LLC, the owner of parcel 0987010011, desires to grant to the City of North Port a non-exclusive access and utility easement over and across certain portions of properties owned by North Port MF Ventures, LLC in connection to the infrastructure installed within the Heron Creek Place Phase 2 development.

 

The easement grants the City access to the property for installation, maintenance, repair and use of the water main, wastewater main, irrigation main, and facilities related to the infrastructure installed on the property, whether above or below ground level. The plat of the parcel was done prior to the installation of the infrastructure; therefore, this easement is necessary now that the water and wastewater infrastructure has been installed and will be dedicated to the City of North Port for maintenance and use. 

 

Resolution No. 2025-R-22 has been reviewed by the Interim City Attorney and is legally correct as to form.
