Background Information
The City of North Port is responsible for identifying and disposing of only what is defined as lost or abandoned personal property. Law enforcement shall continue to follow the procedures set forth in Florida State Statute 705 for the removal of lost or abandoned property on public property. It is necessary and statutorily required in the interests of public health, welfare, safety, security, tranquility and quality of life to adopt an ordinance regulating the placement of personal property kept, left unattended or stored upon public property, private property, and to establish a process for removing such property in a lawful manner.
Background Information for second reading
On January 12, 2021, the City Commission continued this ordinance to second reading, with the following changes:
- 46-3(a)(3) - clarified that the reasonable charge would be only for the storage and/or removal of an item.
- 46-3(b)(2) - clarifies that there will be no citation for a first violation, added “within a 12 month period,” and cleaned up language to support the change.
- 46-3(b)(5) - clarified that property may be stored at a city location, changed the word “space” to “location” throughout to ordinance for consistency.
- 46-3(e)(1) - allows for the application of a reasonable charge for repeated violations within a 12 month period.
