Background Information
During the City Commission Regular Meeting held on November 12, 2024, the City Commission approved the First Amendment and Restatement of the West Villages Developer Agreement (Restated Agreement). The Restated Agreement updates and restates stipulations to meet current level of service standards and the changing needs based on development patterns within the subject property. As part of this amendment, a ±63-acre parcel was identified and designated for future park purposes.
During the City Commission Regular Meeting held on April 8, 2025, the City Commission adopted Resolution 2025-R-21, accepting conveyance of certain real property from West Villages, LLP (WVLP), and authorizing the conveyance of ±63 acres of real property to an affiliate of the WVLP. On May 14, 2025, the Warranty Deed conveying the ±63 acres of real property was recorded in Instrument # 2025074732, Official Records of Sarasota County, Florida. A deficiency in that deed has since been identified regarding compliance with Section 270.11, Florida Statutes. The proposed Resolution will amend the recorded deed to release any reserved statutory rights and ensure the conveyance satisfies the obligations of both the City and Wellen Park under the Restated Agreement.
Resolution No. 2026-R-35 has been reviewed by the City Attorney, and it is legally correct to form.
Resolution No. 2026-R-35 was provided to the City Clerk’s Office on April 27, 2026, for signature, subject to City Commission approval.
