TITLE:                     Approve the Memorandum of Understanding Between the City of North Port, Florida, on Behalf of the North Port Police Department and the United States Secret Service Establishing the Procedures and Responsibilities of Both Parties for Work Performed Under the Cyber Fraud Task Forces.

 

 

Recommended Action

 

Approve the Memorandum of Understanding Between the City of North Port, Florida, on Behalf of the North Port Police Department and the United States Secret Service establishing the procedures and responsibilities of both parties for work performed under the Cyber Fraud Task Forces.

 

Background Information

 

The United States Secret Service (USSS) has formally merged its Electronic Crimes Task Forces (ECTFs) and Financial Crimes Task Forces (FCTFs) into a single unified group, which is now known as the Cyber Fraud Task Forces (CFTFs).  The mission of the CFTF is to prevent, detect, and mitigate complex cyber-enabled financial crimes.  Its ultimate goal is to arrest and convict the most harmful of predators.

 

This Agreement will supersede the current Agreement dated January 14, 2014, and primarily updates the task force name and outlines the procedures and responsibilities of both the North Port Police Department and the Secret Service for:

 

(a)                     Secret Service Digital Evidence Forensic Laboratory (DEFL) Forensic Partners;

(b)                     Reimbursement of certain overtime costs and other expenses;

(c)                     Deputation of law enforcement officers as Secret Service Task Force Officers; and

(d)                     Access to Secret Service systems and/or unescorted access to Secret Service facilities.

 

It will remain in effect until terminated by the mutual agreement of the North Port Police Department and the Secret Service or upon 30 days written notice by either party to the Agreement.

 

The Memorandum of Understanding Between the City of North Port, Florida, on Behalf of the North Port Police Department and the United States Secret Service establishing the procedures and responsibilities of both parties for work performed under the Cyber Fraud Task Forces has been reviewed by the City Attorney and is legally correct as to form.

Financial assistance may be provided to the North Port Police Department for certain overtime costs and other authorized investigative expenses. It does not obligate funds.
