Recommended Action

 

Approve the Comcast Business Service Order and Business Services Customer Terms and Conditions for internet service at Warm Mineral Springs Park for an estimated one-time connection fee and recurring annual service fees in the amount of $3,068.15.

 

Background Information

 

On September 27, 2022, Warm Mineral Springs Park was closed to the public as a protective measure in advance of Hurricane Ian. Due to extensive damage to the facilities as a result of the storm and public safety concerns identified in and around the buildings and grounds, the City Building Official condemned the buildings on October 19, 2022, and ordered the site closed so as not be an attractive nuisance. After completing due diligence, staff presented information related to the estimated costs associated with operational restoration of Warm Mineral Spring Park during the December 8, 2022, City Commission Special Meeting. Subsequent to discussion, Commission provided direction to give National and State Park Concessions, the site management company, a 90-day notice of termination of the Warm Mineral Springs Site Management Agreement. Additionally, direction was provided for the City to move as expeditiously as possible to open Warm Mineral Springs.

 

Parks & Recreation, along with Public Works and Information Technology are working through the logistics associated with reopening the site to the public which includes the placement of a temporary admission building. The building is scheduled for delivery on February 22, 2023.  In order for the City to operate from this location, reliable internet access is required. This access will provide staff with the capability of utilizing point of sale software for all admissions tracking, cash/credit card processing and required daily reconciliation. 

 

Per the terms of the Comcast service agreement, the City may terminate a Service Order or this Agreement, in whole or part, at any time during the Service Term upon thirty (30) days prior notice to Comcast, and subject to payment to Comcast of all outstanding amounts due for the Services, any and all applicable Termination Charges, and the return of any and all Comcast Equipment. Such termination shall be effective thirty (30) days after Comcast’s receipt of the termination notice.

 

To activate the Comcast service, Comcast is requiring a signed Business Service Order.  Upon Commission approval, this service order can be signed by the City Manager.

 

The City Attorney’s Office reviewed this service order and it is legally correct as to form.

Financial Impact

 

To ensure connectivity for point-of-sale software and credit card processing, a reliable internet connection is necessary.  Comcast is the provider for the Warm Mineral Springs area.  The Comcast proposal is for 12 months of service at $244.85 per month, plus an estimated one-time connection fee of $129.95.  This amounts to a proposed annual expenditure of $3,068.15. Funding is available within the Warm Mineral Springs FY24 adopted budget in account number 125-3036-572-31-05 (Professional Services), which will be transferred upon approval to account number 125-3036-572-41-00 (Communication Services).

 

Procurement

 

Per Sec. 2-403, (3) k. Procurement of water, sewer, electrical, cable television, or other utility services are exempt from competitive solicitation.
