Recommended Action

 

Option 1:  Approve and Authorize the City Manager to execute the Memorandum of Understanding (MOU) between the City of North Port, Florida, and the American Federation of State, County and Municipal Employees (AFSCME) Local 3432 regarding Pesticide Applicator Certification Specialty Pay.

 

City Commission Options

 

Option 1:  Approve and Authorize the City Manager to execute the MOU between the City of North Port, Florida, and AFSCME Local 3432 regarding Pesticide Applicator Certification Specialty Pay.

 

                     Pros: Approving this MOU will provide clarification language that was agreed upon by both the City and AFSCME for processing affected employee wages.

                     Cons: Staff have not identified a disadvantage to approving the negotiated MOU.

 

Option 2:  Deny the MOU between the City of North Port, Florida, and the AFSCME Local 3432 regarding Pesticide Applicator Certification Specialty Pay.

 

                     Pros: Staff have not identified an advantage to denying the MOU.

                     Cons: Failure to approve the MOU will continue the ambiguity of the current language for the application of the Pesticide Applicator Certification Specialty Pay.

 

Background Information

 

The City and Local 3432 of the American Federation of State, County and Municipal Employees AFL-CIO (AFSCME) met on April 20, 2026, to negotiate a Memorandum of Understanding (MOU) for the purpose of clarifying language regarding the application of specialty pay provisions contained in Article 32, Section 1(E) of the Collective Bargaining Agreement (“CBA”) as they relate to pesticide applicator certifications. Language was included in the MOU to address how an employee would be eligible for this incentive. An agreement was reached by both parties, and the MOU is attached to this agenda item.

 

The Memorandum of Understanding between the City of North Port, Florida, and the American Federation of State, County and Municipal Employees Local 3432 regarding Pesticide Applicator Certification Specialty Pay has been reviewed by the City Attorney and is legally correct as to form.

 

The Memorandum of Understanding between the City of North Port, Florida, and the American Federation of State, County and Municipal Employees Local 3432 regarding Pesticide Applicator Certification Specialty Pay was provided to the City Clerk’s Office on May 4, 2026, for signature, subject to City Commission approval.

Financial Impact

 

This MOU more clearly identifies the Specialty Pay criteria and issuance eligibility with the CORE Certification ($0.10 per hour).  At this time, there is one City employee this MOU would provide clarity to, resulting in an annual cost of $295 to the City.  The City assumes there would be no other fiscal impacts related to this MOU.
