Recommended Action

 

Approve Resolution No. 2023-R-18 as presented.

 

Background Information

 

Manasota Beach Ranchlands, LLLP (Manasota) is the owner of certain real property associated with well #93 and #94. The City of North Port is the owner of the well permits for groundwater withdrawal associated with both wells. Manasota desires to grant the City a non-exclusive access and utilities easement over and across both wells for maintenance, repair, and use of the groundwater for the purpose of groundwater withdrawal. Manasota also desires to grant the City a non-exclusive buffer and utility easement, which imposes restrictions on certain activities within the buffer areas, as shown within Exhibit A.

 

There are a total of four wells associated with the production of water at the Southwest Water Treatment Plant. Well # 92 was dedicated to the City during the Lakespur subdivision plat and has been recorded in the Sarasota County Public Records as Instrument Number 2023018548, Plat book 57, page 107. Well # 95 was dedicated to the City during the Gran Place subdivision plat and has been recorded in the Sarasota County Public Records as Instrument Number 2021146786, Plat book 55 page 326. Approval of this Resolution would complete the dedication of all four wells associated with the Southwest Water Treatment Plant, which is the subject of Resolution 2023-R-38, also presented at this same meeting.

 

Resolution No. 2023-R-18 has been reviewed by the City Attorney and is legally correct as to form.
