Recommended Action

 

Option 1: Approve Resolution No. 2026-R-12 as presented, authorizing the purchase of real property located on Nimbus Drive, North Port, Florida 34287.

 

City Commission Options

 

Option 1: Approve Resolution No. 2026-R-12 as presented, authorizing the purchase of real property located on Nimbus Drive, North Port, Florida 34287.

 

                     Pros: Acquisition of this parcel supports the District’s need to secure access to Retention Ditch No. 146, ensuring staff can perform necessary rehabilitation and ongoing maintenance to protect drainage infrastructure and reduce the risk of flooding or erosion.

                     Cons: Approval requires the City to expend funds for acquisition and assume long-term ownership responsibilities, including maintenance, landscaping, and general upkeep.

 

Option 2: Deny Resolution No. 2026-R-12 as presented.

 

                     Pros: Denial avoids immediate acquisition costs and eliminates long-term ownership and maintenance responsibilities, allowing funds to be allocated to other potential Public Works’ needs.

                     Cons: Without ownership or access, the City cannot ensure Retention Ditch No. 146 is properly maintained, which may increase the risk of flooding, erosion, or drainage failures that could adversely affect surrounding infrastructure.

 

Background Information

 

The Department of Public Works is seeking to purchase property located along Retention Ditch No. 146, Parcel Identification No. 0980039119, currently owned by Christopher Contreras. Acquisition of this parcel will provide permanent access to the ditch for ongoing maintenance, rehabilitation and emergency operations.

 

Although the City owns parcels on the north side of Retention Ditch No. 146, those parcels do not provide southerly access. This acquisition will establish the only available southern access point, as the ditch is currently inaccessible from that direction. Securing this property will ensure reliable and direct entry for maintenance crews and equipment.

 

An appraisal prepared by Adrian Gonzalez & Associates, P.A on September 30, 2025, determined the market value of the property to be $50,000.00. Following negotiations coordinated by Florida Acquisition & Appraisal Inc., the seller has agreed to sell the property to the North Port Road and Drainage District for $55,000.00.

 

Resolution No. 2026-R-12 has been reviewed by the City Attorney’s Office and is legally correct as to form.

 

Resolution No. 2026-R-12 was provided to the City Clerk’s Office on February 27, 2026, for signature subject to City Commission approval.

Financial Impact

 

Funding in the amount of $55,000.00 is available in the Fiscal Year 2026 Road and Drainage District Budget, account number 107-5000-541.61-00, Capital Project R22RDD.

 

Procurement

 

Purchase of property will be pursuant to Sec.2-403 (a)(3)c of the City of North Port Procurement Code - Real property, real estate brokering, or appraising.
