Recommended Action

 

Option 1: Approve request from Sarasota Memorial Hospital seeking relief from the Code of the City of North Port, Florida, Article II, Division 2. Noice, to allow concrete pouring to occur at the Sarasota Memorial Hospital - Sumter Boulevard Location between the hours of 9:00 p.m. and 7:00 a.m. the following day on weekdays and 9:00 p.m. and 7:30 a.m. on weekends and holidays, beginning February 1, 2026, and extending through September 30, 2028.

 

City Commission Options

 

Option 1: Approve request from Sarasota Memorial Hospital seeking relief from the Code of the City of North Port, Florida,  Article II, Division 2. Noice, to allow concrete pouring to occur at the Sarasota Memorial Hospital - Sumter Boulevard Location between the hours of 9:00 p.m. and 7:00 a.m. the following day on weekdays and 9:00 p.m. and 7:30 a.m. on weekends and holidays, beginning February 1, 2026, and extending through September 30, 2028.

 

                     Pros: Enables large concrete pours to occur during nighttime hours, minimizing daytime traffic congestion, facilitating proper concrete curing time, and maintaining the project schedule. It requires Sarasota Memorial Hospital to provide the City with at least a seven-day written notice prior to any after-hours construction activity.

                     Cons: Nearby residents may be impacted by occasional after-hours noise.

 

Option 2: Deny request from Sarasota Memorial Hospital seeking relief from the Code of the City of North Port, Florida, Article II, Division 2. Noice, to allow concrete pouring to occur at the Sarasota Memorial Hospital - Sumter Location between the hours of 9:00 p.m. and 7:00 a.m. the following day on weekdays and 9:00 p.m. and 7:30 a.m. on weekends and holidays, beginning February 1, 2026, and extending through September 30, 2028.

 

                     Pros: Ensures nearby residents are not impacted by after-hours construction noise.

                     Cons: Large concrete pours would need to occur during daytime hours, potentially creating traffic congestion, prolonging the project schedule, and increasing risk that concrete may not cure properly.

 

Background Information

 

On November 3, 2025, Sarasota Memorial Hospital submitted a formal request to the City for relief from the Code of the City of North Port, Florida, Article II, Division 2. Noise, to provide authorization to perform concrete pouring work outside designated hours beginning February 1, 2026, and extending through September 30, 2028.

 

Specifically, Section 46-42(6) prohibits “operating or permitting the operation of any tools or equipment used in construction, drilling, repair, alteration or demolition work between the hours of 9:00 p.m. and 7:00 a.m. the following day on weekdays or 9:00 p.m. and 7:30 a.m. on weekends and holidays in or within 50 yards of any residential area.” (emphasis added)

 

While most construction activities at the Sarasota Memorial Hospital project site will occur outside of the 50-yard boundary noted above, there will be activities that occur within this area. The Code of the City of North Port, Florida, Article II, Division 2. Noise, authorizes the City Commission to allow activities that would otherwise be in violation of Division 2 upon the following:

 

                     Showing of good cause;

                     Specifying the duration for which such noncompliance shall be permitted;

                     Prescribing the conditions or requirements necessary to minimize adverse effects upon the community or surrounding neighborhood. 

 

Sarasota Memorial Hospital has offered the following to address the above provisions:

 

                     Good Cause

o                     Multiple large concrete pours are needed at various stages of the project. These pours will require a significant number of concrete trucks to utilize Sumter Boulevard and enter the project site. Conducting these pours during daytime hours would likely create traffic congestion during morning rush hours as concrete trucks queue and enter the site.

o                     Because of the large volume of concrete involved, conducting the pours at night, when cooler temperatures slow the curing process, allows crews sufficient time to work with the material.

                     Specifying the duration for which such noncompliance shall be permitted

o                     Sarasota Memorial Hospital is requesting authorization beginning February 1, 2026, and extending through September 30, 2028. While the requested work will not be continuously occurring, this window prevents the need for multiple requests and potential project delays.

                     Prescribing the conditions or requirements necessary to minimize adverse effects upon the community or surrounding neighborhood. 

o                     Sarasota Memorial Hospital will provide the City with at least a seven-day written notice prior to any after-hours construction activity. This will enable to City to communicate to the public through available communication channels and provide awareness to the North Port Police Department in the event calls are received through 911 or the non-emergency number.
