SUBJECT:                     A Resolution of the City Commission of the City of North Port, Florida, Vacating a Portion of Maintenance, Utility, and Drainage Easements for Lot 23, Block 1936, Forty-First Addition to Port Charlotte Subdivision; Providing for Findings; Providing for Recording; Providing for Conflicts; Providing for Severability; and Providing an Effective Date. Recommended Action

 

The City Commission approve Resolution 2023-R-33.

 

General Information

 

Pursuant to Chapter 177.101, Florida Statutes, homeowner, Miroslaw Czekanski, submitted an application to the Planning & Zoning Division petitioning the City of North Port to grant a vacation of a portion of the platted rear 20-foot Maintenance Easement and a portion of the platted rear 10-foot Drainage and Utility Easement located on Lot 23, Block 1936, Forty-First Addition to Port Charlotte Subdivision. The applicant is requesting to vacate a 570.32 sq ft portion of the platted 20-foot rear maintenance easement and a 31.73 sq ft portion of the platted 10-foot rear drainage and utility easement, to allow an existing pool, pool deck, and screened enclosure to remain. The subject property is zoned Residential Single-Family (RSF-2) with a Future Land Use designation of Low Density Residential.

The petition is for the vacation of a portion of the Platted twenty (20) foot Rear Maintenance & Rear ten (10) foot Utility and Drainage Easements at 3134 Mola Street. 

A legal notice of intent to vacate the easements was published by the property owners in a newspaper of general circulation for two (2) weeks consecutively.

The petition has been reviewed by all applicable utility agencies and all, through written responses, have granted approval or have no objection.

The City Attorney has reviewed and approved Resolution 2023-R-33 as to form and correctness.

At their April 20, 2023, regular meeting, the Planning and Zoning Advisory Board voted unanimously to recommend approval.
