Recommended Action
Option 1: Approve the Third Amendment to Agreement No. 2021-41 Professional Engineering Services for Cranberry Boulevard/Hillsborough Boulevard intersection improvements design & permitting for western leg of roundabout design modifications to scope and price by and between the City of North Port, Florida and Kimley-Horn and Associates, Inc. in the amount of $53,000.00.
City Commission Options
Option 1: Approve the Third Amendment to Agreement No. 2021-41 Professional Engineering Services for Cranberry Boulevard/Hillsborough Boulevard intersection improvements design & permitting for western leg of roundabout design modifications to scope and price by and between the City of North Port, Florida and Kimley-Horn and Associates, Inc. in the amount of $53,000.00.
• Pros: Design will be revised to properly connect with the proposed driveway of the adjacent properties. These properties will be more inclined to sign the temporary construction easements necessary for the roundabout’s construction without the need for the eminent domain process.
• Cons: These funds will not be available for other potential Public Works needs or projects.
Option 2: Deny the Third Amendment to Agreement No. 2021-41.
• Pros: Preserves these funds for other potential Public Works needs or projects.
• Cons: The City would need to utilize the eminent domain process to obtain the temporary construction easements necessary for the roundabout’s construction. Additional challenges would be faced when the adjacent properties are developed and the need to provide access arises.
Background Information
On March 22, 2022, the City Commission approved Agreement No. 2021-41 with Kimley-Horn and Associates, Inc. for professional engineering services for the Cranberry Boulevard/Hillsborough Boulevard Intersection Improvements design and permitting project.
On October 24, 2023, the City Commission approved the First Amendment, which added drainage design changes needed to avoid land acquisition problems and increased the cost by $65,780.00.
On July 23, 2024, the City Commission approved the Second Amendment, which added lighting design changes requested by the Florida Department of Transportation (FDOT) during their permit review process and increased the cost by $20,615.00.
The design plans have been completed, and all permits have been obtained for this intersection improvement project. During design, staff identified the need for temporary construction easements (TCE) on two parcels west of the roundabout, one of which is owned by RaceTrac Petroleum, Inc. (RaceTrac) and the other owned by AdventHealth Port Charlotte, Inc. (AdventHealth).
In August 2025, AdventHealth held a pre-application meeting with Development Services to discuss development plans for their property, which includes the phased construction of a medical care complex, starting with an emergency care center, and eventually expanding into a full-service hospital and medical office building. During the pre-application meeting, the City’s plans for the roundabout as well as the need for the TCE’s were shared with the applicant.
On January 29, 2026, the City held a joint meeting with both AdventHealth and RaceTrac to discuss the roundabout project and the need to come to an agreement on a driveway configuration that is amenable to all parties.
On March 2, 2026, Catalyst Design Group, under contract with AdventHealth, prepared concept drawings for a driveway that would serve both properties and integrate with the proposed roundabout. The concept drawings were prepared in collaboration with RaceTrac.
The revised configuration of the driveway requires revisions to be made to the completed roundabout plans. The Third Amendment to Agreement No. 2024-41 adds to the scope a redesign of the western leg of the roundabout to integrate the proposed driveway configuration that has been proposed by Catalyst Design Group.
The Third Amendment to Agreement No. 2024-41 increases the cost of the professional services agreement by $53,000.00, resulting in a total contract value of $528,555.00.
The Third Amendment to Agreement No. 2021-41 has been reviewed by the City Attorney’s Office and is legally correct as to form.
The Third Amendment to Agreement No. 2021-41 was provided to the City Clerk’s Office on March 30, 2026 for signature subject to City Commission approval.

Funding in the amount of $53,000.00 is available in Fiscal Year 2026 Road and Drainage District Budget, Project Number R20HCI, account number 153-5000-541.63-00.
Procurement
Professional Engineering Services were procured, for Agreement 2021-41, pursuant to Chapter 2 Administration, Article VIII Procurement, Section 2-406 - Professional services selection under Consultants’ Competitive Negotiation Act (CCNA), F.S. §287.055 of the Code of the City of North Port, Florida.
