Recommended Action

 

Approve Resolution No. 2025-R-01 as presented.

 

Background Information

 

On August 16, 2024, the Planning & Zoning Division received an application petitioning the City of North Port to grant a vacation of a portion of the platted rear 20-foot drainage and public utility easement located on Lot 13, Block 1345 of the 26th Addition to the Port Charlotte Subdivision (7874 Taplin Avenue). The applicant is requesting to vacate a portion of the 20-foot rear easement, approximately 327 square feet, in order to construct a new in-ground swimming pool and pool cage. The subject property is zoned Residential Single Family (R-1) with a Future Land Use designation of Low Density Residential. 

 

Pursuant to Florida Statutes Chapter 177, an application has been made to the City of North Port to formally request to vacate the platted 20-foot Drainage Maintenance Easement for Lot 13, Block 1345, 26th Addition to Port Charlotte Subdivision.

 

A legal notice of intent to vacate the easements was published by the property owners in a newspaper of general circulation, for two (2) weeks consecutively.

 

The affected drainage and utility agencies have been notified of the vacation request and through written responses, have granted their approval.

 

Resolution No. 2025-R-01 has been reviewed by the Interim City Attorney and is legally correct as to form.

During their Regular Meeting held on December 19, 2024, the Planning and Zoning Advisory Board recommended unanimously (5-0) City Commission approval of Resolution No. 2025-R-01, VAC-24-134.
