Recommended Action
Rescind Subrecipient Agreement B-23 for the Ponce De Leon Shared Use Project Between Sarasota County, Florida, and the City of North Port, Florida in the Amount of $325,000 and Approve the New Subrecipient Agreement B-23 in the Amount of $325,000 for Biscayne Erosion Control and Authorize the City Manager or the Mayor, as Applicable Under the City Charter, to Execute all Funding Documents After Legal Review.
Background Information
In 2024, The City of North Port was awarded a Community Development Block Grant (CDBG) in the amount of $325,000 for the Ponce De Leon sidewalk extension project. This contract was approved as Item 24-0165 at the May 28, 2024, Commission meeting.
However, the City was subsequently informed by the County that this project was no longer eligible because it did not sufficiently benefit low- and moderate-income (LMI) persons as previously thought. This fact was detailed to Commission in a memo sent on September 5, 2024, and the memo is attached to this agenda item.
The City worked successfully with the County to find an alternative project and has now been awarded a Subrecipient Agreement with Sarasota County for the receipt and use of CDBG funds for the Biscayne Erosion Control Project. The grant will reimburse the City up to $325,000 for Biscayne Erosion Control construction costs and replaces the contract for the Ponce De Leon Sidewalk extension.
The erosion control project will prevent flooding near Biscayne Drive and Trionfo Avenue. This area can no longer be mowed, and the vegetation needs to be replaced with something permanent that will allow for free flow of water through the canal bordered by houses along Alam Avenue to the north of the canal and Trionfo Avenue to the south.
This is a reimbursable grant, meaning the City will spend first and then request reimbursement from the granting agency.
This contract has been reviewed for form and correctness by City Attorney.

Financial Impact
The total project cost is estimated at $1,067,000 for design and construction of the required erosion control. The maximum award from the grant is $325,000. This City has also received a second CDBG Award for this project (see Agenda Item 25-2033) in the amount of $166,120. Total CDBG funds available for this project are $491,120. Remaining funds will come from Road and Drainage District Surtax funding account numbers 107-5000-541.63-00 and 306-5000-541.63-00. There is no match required for these grants.
