Rich Esq. on Behalf of the Property’s Owners Clifford and Alicia Charbonneau, Request to Vacate a Portion of the Platted Rear Ten-Foot (10’) Utility and Drainage Easement on Lot 18 Block 1310, Twenty-Sixth Addition to Port Charlotte Subdivision so that an Existing Carport May Remain in Place (QUASI-JUDICIAL).

General Information
On June 20, 2022, the Planning & Zoning Division received the completed application petitioning the City of North Port to grant a vacation of a portion of the platted rear 10-foot Utility and Drainage Easement located on Lot 18, Block 1310, 26th Addition to Port Charlotte Subdivision. The applicant is requesting to vacate a portion of the platted rear 10-foot easements, so that an existing carport may remain in place. The subject property is zoned Residential Single-Family (RSF-2) with a Future Land Use designation of Low Density Residential.
Pursuant to Florida Statutes Chapter 177, an application has been made to the City of North Port to formally request to vacate a ±719 sf portion of the platted rear ten-foot (10’) Utility and Drainage easement on Lot 18, Block 1310, 26th Addition to Port Charlotte Subdivision.
A legal notice of intent to vacate the easements was published by the property owners in a newspaper of general circulation for two (2) weeks consecutively on April 30, 2022, and May 7, 2022.
The affected utility agencies have been notified of the vacation request and through written responses, have granted their approval.
Resolution 2022-R-60 has been reviewed by the City Attorney and is legally correct as to form.
During their Regular Meeting on September 1, 2022, the Planning and Zoning Advisory Board reviewed and considered Resolution No. 2022-R-60, VAC-22-128. At the conclusion of the Meeting, the Planning and Zoning Advisory Board voted to recommend approval of Resolution 2022-R-60, VAC-22-128 to the City Commission.
