Recommended Action

 

Discussion and possible action regarding the potential demolition of the structure on the City-owned property at 5891 Jessamine Avenue.

 

Background Information

 

The following provides a chronological order of events regarding the City-owned property at 5891 Jessamine Avenue:

 

Ø                     April 23, 2007: During the City Commission Regular Meeting, the Commission adopted Resolution No 07-R-11, authorizing acquisition of certain real property along the Myakkahatchee Creek Corridor for the purpose of preserving and enhancing the Myakkahatchee as a Class I potable water supply and natural resource amenity.

 

Ø                     May 12, 2020:  During the City Commission Regular Meeting, the Commission adopted Resolution 2020-R-13, for the purchase of the property at 5891 Jessamine Avenue, North Port, Florida, 34291-6371, Parcel Identification Number 0967058935.

 

Ø                     Subsequent to the adoption of Resolution No. 2020-R-13, the property at 5891 Jessamine Avenue was purchased via account no. 170-3036-572.61-00 which was funded following a State of Florida Department of Environmental Protection (DEP) Consent Order dated December 15, 1997, from fines incurred by General Development Corporation.

 

The property at 5891 Jessamine Avenue is a Tier 2 property along the Myakkahatchee Creek.  This property is improved with a single-family residence which has remained vacant since the City’s purchase. The properties along this corridor were identified by the Commission to acquire to preserve and enhance the Myakkahatchee as a Class I potable water supply and natural resource amenity.

 

This corridor has historically been susceptible to flooding due to tropical storms and hurricanes. The single-family residence located at 5891 Jessamine Avenue experienced significant damage resulting from the impacts from Hurricane Ian. Due to this damage and likelihood of repeated flooding, staff recommends the following:

 

Ø                     The single-family residence located at 5891 Jessamine Avenue shall be evaluated for demolition within the Federal Emergency Management Agency (FEMA) guidelines.

 

Ø                     The property located at 5891 Jessamine Avenue shall be allowed to revert to natural land supporting habitat and hydrology.

Financial Impact

 

Subsequent to the adoption of Resolution 2020-R-13, the property located at 5891 Jessamine Avenue, North Port, Florida, 34291-6371 was purchased for $214,926.00 including closing costs and expenses.

 

Additional financial impacts will be evaluated pending Commission direction and evaluation of reimbursement options via insurance coverage and within any applicable FEMA guidelines.

 

Procurement

Section 2-403 in Article VIII, Procurement, of the Code of the City of North Port outlines exemptions including item c. which exempts “Real property, real estate brokering, or appraising” and item d. “Abstract of titles for real property; title insurance.”
