TITLE: Approve Amendment No. 3 to Contract No. 2020-56 with Waterfield Florida Staffing, LLC d/b/a Action Labor of Florida d/b/a Staffing Connection for School Crossing Guard Services for Purposes of Extending Contract Time Until the New Solicitation is Awarded in Accordance With the Hourly Rates.
Recommended Action
Option 1: Approve Amendment No. 3 to Contract No. 2020-56 with Waterfield Florida Staffing, LLC d/b/a Action Labor of Florida d/b/a Staffing Connection for school crossing guard services for purposes of extending contract time until the new solicitation is awarded in accordance with the hourly rates.
City Commission Options
Option 1: Approve Amendment No. 3 to Contract No. 2020-56 with Waterfield Florida Staffing, LLC d/b/a Action Labor of Florida d/b/a Staffing Connection for school crossing guard services for purposes of extending contract time until the new solicitation is awarded in accordance with the hourly rates.
• Pros: Approval of the Third Amendment to Contract No. 2020-56 will ensure uninterrupted school crossing guard services until a new solicitation is awarded, maintaining critical public safety measures for children, pedestrians, and motorists within school zones.
• Cons: Staff has not identified any foreseeable consequence to approving the Third Amendment to Contract No. 2020-56 School Crossing Guard Services for purposes of extending contract time until the new solicitation is awarded.
Option 2: Deny Amendment No. 3 to Contract No. 2020-56 with Waterfield Florida Staffing, LLC d/b/a Action Labor of Florida d/b/a Staffing Connection for school crossing guard services for purposes of extending contract time until the new solicitation is awarded in accordance with the hourly rates.
• Pros: Staff has not identified any foreseeable benefits to denying the Third Amendment to Contract No. 2020-56 School Crossing Guard Services for purposes of extending contract time until the new solicitation is awarded.
• Cons: Denial of the Third Amendment to Contract No. 2020-56 could result in a lapse of school crossing guard services if the new solicitation is not awarded before the current contract expires, negatively impacting public safety in and around school zones, creating operational and staffing disruptions, and increasing potential liability risks to the City due to reduced pedestrian and traffic safety measures near schools.
Background Information
On July 28, 2020, the City entered into Contract No. 2020-56 with Waterfield Florida Staffing, LLC d/b/a Action Labor of Florida d/b/a Staffing Connection to provide School Crossing Guard Services for the City. The Contract was subsequently amended in September 2022 and July 2024 to increase the hourly billing rate. The proposed Third Amendment does not modify pricing or scope of services but instead extends the contract term until a new solicitation is awarded and a replacement contract is executed. The purpose of the extension is to ensure continuity of crossing guard services without interruption for the safety of school children, pedestrians, motorists, and the public within school zones.
Amendment No. 3 to Contract No. 2020-56 with Waterfield Florida Staffing, LLC d/b/a Action Labor of Florida d/b/a Staffing Connection for school crossing guard services for purposes of extending contract time until the new solicitation is awarded in accordance with the hourly rates has been reviewed by the City Attorney and it is legally correct to form.
Amendment No. 3 to Contract No. 2020-56 with Waterfield Florida Staffing, LLC d/b/a Action Labor of Florida d/b/a Staffing Connection for school crossing guard services for purposes of extending contract time until the new solicitation is awarded in accordance with the hourly rates was provided to the City Clerk’s Office on June 3, 2026, for signature, subject to City Commission Approval.

Procurement
The Crossing Guard Services were procured pursuant to Chapter 2 - Administration, Article VIII - Procurement, Section 2-404 - Competitive Sealed Bid Process of the Code of the City of North Port, Florida.
The Police Department will process the procurement forms to ensure compliance with the City procurement policies and procedures.
