Recommended Action

 

Option 1:  Approve the Fourteenth Amendment to Construction Manager at Risk Contract No. 2023-17.004 for Construction Services Contract Phase II, Work Assignment #2025-55FM, by and between the City of North Port, Florida, and Jon F. Swift, Inc., for services at Marina Park Coast Guard and Auxiliary Dock, 7030 Chancellor Boulevard, North Port, Florida, 34287, in the amount of $74,101; Water Control Structure 117 North Side Kayak Launch, 5661 Barlow Terrace, North Port, Florida, 34287, in the amount of $121,344; and Water Control Structure 117 South Side Kayak Launch, in the amount of $121,344 for a total approved amount not to exceed $316,789.

 

City Commission Options

 

Option 1:  Approve the Fourteenth Amendment to Construction Manager at Risk Contract No. 2023-17.004 for Construction Services Contract Phase II, Work Assignment #2025-55FM, by and between the City of North Port, Florida, and Jon F. Swift, Inc., for services at Marina Park Coast Guard and Auxiliary Dock, 7030 Chancellor Boulevard, North Port, Florida, 34287, in the amount of $74,101; Water Control Structure 117 North Side Kayak Launch, 5661 Barlow Terrace, North Port, Florida, 34287, in the amount of $121,344; and Water Control Structure 117 South Side Kayak Launch, in the amount of $121,344 for a total approved amount not to exceed $316,789.

 

                     Pros: Restores kayaking opportunities at Marina Park and Water Control Structure 117 and re-establishes waterway connectivity in alignment with the City’s Blueways Plan. These amenities are supported in the recently adopted Parks & Recreation Master Plan and the Canal & Creek Master Plan. This work returns the park sites to pre-storm condition.

                     Cons: Financial impact of $316,789, which will be submitted to Federal Emergency Management Agency (FEMA) for potential reimbursement; however, recovery is not guaranteed.

 

Option 2:  Deny the Fourteenth Amendment to Construction Manager at Risk Contract No. 2023-17.004 for Construction Services Contract Phase II, Work Assignment #2025-55FM, by and between the City of North Port, Florida, and Jon F. Swift, Inc., for services at Marina Park Coast Guard and Auxiliary Dock, 7030 Chancellor Boulevard, North Port, Florida, 34287, in the amount of $74,101; Water Control Structure 117 North Side Kayak Launch, 5661 Barlow Terrace, North Port, Florida, 34287, in the amount of $121,344; and Water Control Structure 117 South Side Kayak Launch, in the amount of $121,344 for a total approved amount not to exceed $316,789.

 

 

                     Pros: Preserves $316,789 in general fund money designated for Hurricane Ian repairs.

                     Cons: The kayak launches destroyed by Hurricane Ian will not be replaced, and the sites will not return to pre-storm condition.

 

Background Information

 

As a result of impacts from Hurricane Ian, the kayak launches at Marina Park and near Water Control Structure (WCS) 117 suffered extensive damage. As outlined in the Rostan Damage Assessment Report, the floating docks, floating launches, and gangways require full replacement. 

 

Ø                     September 24, 2024: City Commission approved the Sixth Amendment to Construction Manager at Risk Contract No. 2023-17.002 for Construction Services Contract, Phase II with Halfacre Construction Company in the amount of $35,946.68, for Hurricane Ian Repairs at Marina Park. While most repairs were completed, the subcontractor was unable to meet the Army Corps permitting requirements for the kayak launch work and credit for that portion of the scope has been received.

 

Ø                     December 5, 2025: Due to the permitting complexity associated with the kayak launch repairs and installation at Marina Park and based on Jon F. Swift Inc.’s demonstrated success with Army Corps permitting and completion of six prior City kayak launch replacements, the City assigned the work directly to this contractor. The two (2) launches located at WCS 117 were inadvertently omitted from previous assignments and combining them with Marina Park provided economy of scale. Work Assignment No. 2025-55FM was issued to Jon F. Swift, Inc. for Preconstruction Phase (Phase 1) services, during which the contractor obtained quotes from applicable subcontractors, and developed the Guaranteed Maximum Price (GMP).

 

Ø                     January 30, 2026: Jon F. Swift, Inc. submitted a GMP proposal. This Amendment to Contract No. 2023- 17.004 presented for approval is for the Construction Phase (Phase II) of the process.

Procurement

 

Contract 2023-17.004 was procured pursuant to Sec. 2-406 Professional Services selection under the Consultants Competitive Negotiation Act (CCNA), F.S. § 287.055 of the Code of the City of North Port, Florida.

 

CMaR Process:

 

Ø                     Phase I - The Contractor has been selected and a Work Assignment for the Pre-Construction Phase has been issued.

 

Ø                     Phase II - The GMP for the Construction Phase was negotiated for Hurricane Ian repairs at Marina Park, and WCS 117 - North and South Kayak Launches.
