Recommended Action
Option 1: Approve the LexisNexis Risk Solutions Master Terms & Conditions - Government and Schedule A, by and between LexisNexis Risk Solutions FL Inc. and City of North Port, Florida, for the North Port Police Department for TraX and VIPER (Virtual Pen Register) software subscription in the annual amount per Schedule A with automatic renewal terms and fee increases.
City Commission Options
Option 1: Approve the LexisNexis Risk Solutions Master Terms & Conditions - Government and Schedule A, by and between LexisNexis Risk Solutions FL Inc. and City of North Port, Florida, for the North Port Police Department for TraX and VIPER (Virtual Pen Register) software subscription in the annual amount per Schedule A with automatic renewal terms and fee increases.
• Pros: This Contract allows the North Port Police Department to lawfully and efficiently analyze cellular and geolocation data during investigations. The TraX and VIPER software helps Investigators quickly identify patterns and connections, improving case efficiency and public safety.
• Cons: Commits funds for this project that could potentially be utilized for other projects.
Option 2: Deny the LexisNexis Risk Solutions Master Terms & Conditions - Government and Schedule A, by and between LexisNexis Risk Solutions FL Inc. and City of North Port, Florida, for the North Port Police Department for TraX and VIPER (Virtual Pen Register) software subscription in the annual amount per Schedule A with automatic renewal terms and fee increases.
• Pros: Allows for the use of funds for other purposes.
• Cons: Will not provide the accessibility of critical investigative information that could lead to criminal apprehension and successful prosecution.
Background Information
TraX and VIPER is a web-based software system offered through LexisNexis Risk Solutions. It allows Police Detectives to quickly gather critical investigative data using call detail record analysis. Patterns of Dive analysis can be conducted to find a subject’s location more quickly and efficiently. The Virtual Pen Register offers a graphic interface that is used to enhance geolocation investigations in real time.
Schedule A amends the existing LexisNexis subscription, previously approved by the City Commission during the City Commission Regular Meeting held on March 26, 2024, to add the Virtual Pen Register Fee. This addition provides a graphic interface to support real-time geolocation investigations. The subscription term is January 1, 2026, through December 31, 2027, with automatic renewal for successive twelve (12)-month periods unless either party provides notice of termination at least sixty (60) days prior to the end of the renewal term.
