TITLE:                     Approve the Third Amendment to Agreement No. 2021-17 Professional Architectural and Engineering Services in the Amount of $3,894,938.00 for City of North Port Police Department Facilities to Expand the Scope of Service of Schenkel & Shultz, Inc. (“Consultant”) to Phase III - Design Development and Phase IV - Construction Documents for the New Police Headquarters Facility for a Total Consultant Fee of $5,350,768.00.

 

 

Recommended Action

 

Approve the Third Amendment to Agreement No. 2021-17 Professional Architectural and Engineering Services in the amount of $3,894,938.00 for City of North Port Police Department Facilities to expand the scope of service of Schenkel & Shultz, Inc. (“Consultant”) to Phase III - Design Development and Phase IV - Construction Documents for the new Police Headquarters Facility for a total consultant fee of $5,350,768.00.

 

Background Information

 

The following provides a chronological order of events pertinent to the City of North Port Police Department Facilities:

 

Ø                     April 12, 2022: The parties entered into Agreement No. 2021-17 Professional Architectural and Engineering Service for City of North Port Police Department Facilities (“Original Agreement”) for architectural and engineering services and construction administration services for renovation of the existing North Port Police Department facility and design of the new Emergency Operations Center (“EOC”), 911 telecommunications center, and evidence facility.  

 

Ø                     March 2, 2023:  During the City Commission Special Meeting, agenda item 23-0262, the recommendation to build an entirely new Police Headquarters and Emergency Operations Center (EOC) facility, in lieu of renovating and expanding the current Headquarters, was presented to Commission.  At the conclusion of Commission’s discussion, the following motions were approved:

 

ü                     Motion 1: Direct the City Manager to proceed with the facility needs of the North Port Police Station to expand at a new location to be determined.  On April 25, 2023, Commission approved the First Amendment to Agreement No. 2021-17 to expand the scope of service, time and related fees of Schenkel & Shultz (“Consultant”), to allow Consultant to begin environmental evaluations on selected parcels for a new Police Headquarters.

 

ü                     Motion 2: Direct the City Manager to authorize the identification and debate with identified property owner for a purchase price to be brought back to Commission.  On July 25, 2023, Commission approved the purchase of five parcels located on North Toledo Blade Boulevard for a new Police Headquarters.

 

ü                     Motion 3: Authorize staff to work with the engineering firm Schenkel & Shultz to prepare a 30% site, drainage and construction plan including the EOC, contingent upon City Commission approval of the purchase of the property.  On September 12, 2023, Commission approved the Second Amendment to Agreement No. 2021-17 to expand the scope of service, time and related fees of Schenkel & Shultz (“Consultant”), to allow Consultant to enter into Phase II - Schematic Design.

 

ü                     Motion 4: Direct the City Manager to bring back all financing options for construction of the North Port Police Station and EOC. On April 1, 2024, a City Commission Special Meeting was held to review projects in the approved 2024-2028 Capital Improvement Plan and Surtax IV project list and other potential funding sources for design and construction of the new police headquarters. On April 23, 2024, a City Commission Special Meeting was held to discuss bonding and other financing options with the City’s special legal counsel and financial advisor for construction of the new Police Headquarters.

 

Ø                     April 1, 2024:  During the City Commission Special Meeting, agenda item 24-0536, the Commission approved a motion to instruct staff to use $4,000,000 from the General Fund balance for the design of the site, drainage and construction plans and permitting for the Police Headquarters to 100%.

 

Ø                     May 14, 2024:  During the City Commission Regular Meeting, the Commission approved Resolution No. 2024-R-17, funding for the design of the new Police Department Headquarters to 100%.

 

The Third Amendment to Agreement No. 2021-17 Professional Architectural and Engineering Services in the amount of $3,894,938.00 for City of North Port Police Department Facilities to Expand the Scope of Service of Schenkel & Shultz, Inc. (“Consultant”) to Phase III - Design Development and Phase IV - Construction Documents for the New Police Headquarters Facility has been reviewed by the City Attorney and is legally correct as to form.

Financial Impact

 

Funds in the amount of $4,000,000.00 are available in general fund account 001-2100-521.31-05. Of the appropriated funds, $3,894,938.00 will be allocated to Consultant Schenkel & Shultz to proceed with Phase III and Phase IV of Project PD21PE. The remainder of the funds will be applied to Construction Manager at Risk fees.

 

Procurement

 

Professional Engineering Services were procured pursuant to Chapter 2 Administration, Article VIII Procurement, Section 2-406 - Professional services selection under Consultants’ Competitive Negotiation Act (CCNA), F.S. §287.055 of the Code of the City of North Port, Florida.
