Recommended Action

 

Option 1: Discussion regarding the City Attorney’s 6-month performance evaluation, with action to approve an adjustment to the base salary.

Option 1: Discussion regarding the City Attorney’s 6-month performance evaluation, with action to approve an adjustment to the base salary.

 

                     Pros: Fosters a culture of recognition and appreciation, moves towards competitive compensation for experience and knowledge, and allows for increased job satisfaction.

 

                     Cons: Encumbers funding that could be utilized elsewhere

 

Option 2: Discussion regarding the City Attorney’s 6-month performance evaluation, without action to approve an adjustment to the base salary.

 

                     Pros: Allows funding to be utilized elsewhere

 

                     Cons: Increases the disparity of competitive compensation for the City Attorney

 

Background Information

 

During the City Commission Regular Meeting held on September 23, 2025, the City Commission approved the Employment Agreement (“the Agreement”) for Michael Fuino to serve as City Attorney.

 

The City Commission must conduct an initial performance evaluation of the City Attorney at or around six (6) months from October 15, 2025, the effective date of the Agreement, pursuant to Article II, Section I (1).

 

The City Attorney has provided a self-evaluation for the Commission which is included along with the Commissioners’ evaluations for consideration.

Financial Impact

 

The Commission will consider an adjustment to the City Attorney’s base salary of up to $5,000.00 based on the result of the City Attorney's initial performance evaluation pursuant to Article II, Section I (1) of the Agreement. The Agreement may also be amended, in whole or in part including any amendment to compensation, by written agreement between the parties pursuant to Article VIII (F).

 

Funding for the potential increase is available in Account No. 001-0200-514.11-00
