TITLE:                     Approve the Requested Operational and Voluntary Cooperation Agreement for Mutual Aid Between the City of North Port Police Department and the City of Punta Gorda Police Department for the Parties to Cross Jurisdictional Lines to Assist and Protect Citizens in Both Jurisdictions.

 

 

Recommended Action

 

Approve the Requested Operational and Voluntary Cooperation Agreement for Mutual Aid Between the City of North Port Police Department and the City of Punta Gorda Police Department for the parties to cross jurisdictional lines to assist and protect citizens in both jurisdictions.

 

Background Information

 

The City of North Port Police Department and the City of Punta Gorda Police Department have the authority under Florida Statutes, Chapter 23, Part 1, known as the Florida Mutual Aid Act to enter an Operational and Voluntary Cooperation Agreement. This allows both parties to cross jurisdictional lines to assist and protect citizens of both jurisdictions should such assistance be requested by either law enforcement agency.

 

It is the intent of the parties to this Agreement to authorize voluntary cooperation and assistance of a routine law enforcement nature across jurisdictional lines including, but not limited to, the following:

 

a.                     Criminal activity

b.                     Domestic complaints

c.                     Motor vehicle accidents

d.                     Emergencies involving threat to safety of persons or property

 

This Agreement will supersede the current 2019 Agreement and will remain in effect until terminated in writing by either party.

 

The Requested Operational and Voluntary Cooperation Agreement has been reviewed by the City Attorney and is legally correct as to form.
