TITLE: Approve Third Amendment to Construction Manager at Risk Contract No. 2023-17.003 for Construction Services Contract, Phase II With Ajax Building Company, LLC., in the Amount of $677,239.55, for Hurricane Ian Repairs to the George Mullen Activity Center.
Recommended Action
Approve Third Amendment to Construction Manager at Risk Contract No. 2023-17.003 for Construction Services Contract, Phase II with Ajax Building Company, LLC., in the amount of $677,239.55, for Hurricane Ian repairs to the George Mullen Activity Center.
Background Information
As a result of impacts from Hurricane Ian, the George Mullen Activity Center suffered damages to the roof, soffits, flashing, gutters, downspouts, and interior ceilings and walls, as outlined in the Halliwell Construction Services and Rostan Damage Assessment Report.
In consultation with City Administration, the use of the Construction Manager at Risk (CMaR) Continuing Services Contract has been identified as the most expedient path to complete this project. The following describes the CMaR process specific to this project:
Ø December 28, 2023: Work Assignment No. 2024-19FM was issued to Ajax Building Company, LLC. for Pre-Construction Phase (Phase I) services. During this phase, the Contractor evaluated the work required, obtained quotes from applicable contractors, and developed the Guaranteed Maximum Price (GMP).
Ø May 24, 2024: Ajax Building Company, LLC. submitted a GMP proposal. This Amendment to Contract No. 2023-17.003 presented for approval is for the Construction Phase (Phase II) of the process. The Project Manager with the Department of Public Works provided a direct selection of Ajax Building Company, LLC. as the preferred CMaR to carry out the project at the George Mullen Activity Center and requests approval of this Amendment to proceed to construction.
The Third Amendment to Construction Manager at Risk Contract No. 2023-17.003 for Construction Services Contract, Phase II with Ajax Building Company, LLC. for Hurricane Ian repairs at the George Mullen Activity Center has been reviewed by the Interim City Attorney and is legally correct as to form.

Financial Impact
Funding in the amount of $677,239.55, including allowances for escalation and additional insurance requirements is allocated in the Parks & Recreation Department budget, Project No. IAN22, account number 001-3038-572-46-03, and will be offset by contingency allowances for Hurricane Ian work.
Procurement
Contract No. 2023-17.003 was procured pursuant to Sec. 2-406 Professional Services selection under the Consultants Competitive Negotiation Act (CCNA), F.S. § 287.055 of the Code of the City of North Port, Florida.
CMAR Process:
Ø Phase I: The Contractor is selected and issued a Work Assignment for the Pre-Construction Phase.
Ø Phase II: The GMP for the Construction Phase was negotiated for Hurricane Ian repairs at George Mullen Activity Center.
