TITLE:                     Approve the Eleventh Amendment to Construction Manager at Risk Contract No. 2023-17.002 for Construction Services Contract, Phase II With Halfacre Construction Company in the Amount of $318,101.31, for Repairs/ Replacement of the Myakkahatchee Bridge and Observation Deck at the Myakkahatchee Creek Environmental Park.

 

 

Recommended Action

 

Approve the Eleventh Amendment to Construction Manager at Risk Contract No. 2023-17.002 for Construction Services Contract, Phase II with Halfacre Construction Company in the amount of $318,101.31, for repairs/replacement of the Myakkahatchee bridge and observation deck at the Myakkahatchee Creek Environmental Park.

 

Background Information

 

The following provides a chronological order of events pertinent to the repairs/replacement of the Myakkahatchee bridge and observation deck at the Myakkahatchee Creek Environmental Park:

 

Ø                     Early 2023:  Pennoni Associates Inc., an engineering firm specializing in park improvements, was contracted to assess the structural conditions of the bridge and deck located at Myakkahatchee Creek Environmental Park, 6968 Reisterstown Road in North Port, following visual observations of damage by staff.

 

Ø                     February 17, 2023:  Pennoni issued a letter to the City of North Port advising that there is significant risk of collapse; detachment or dislodgement of the bridge and observation deck under service load, as defined by Section 202 of the 2020 Florida Existing Building Code related to the structural conditions.  As such, both amenities were closed to the public later that day. The equestrian bridge will be replaced, and the observation deck will be reconfigured and repaired pursuant to the drawings created by Pennoni to implement the improvements.

 

Ø                     Halfacre Construction, as part of Work Assignment (WA) 2024-40FM has completed the drawing review and bidding. Upon award of this Eleventh Amendment, Halfacre Construction will mobilize to complete bridge replacement and observation deck repairs. Contingent upon City Commission approval being granted on October 8, 2024, Halfacre anticipates completion of these repairs by January 13, 2025.

 

In consultation with City Administration, the use of the Construction Manager at Risk (CMaR) Continuing Services Contract has been identified as the most expedient path to complete this project. The following describes the CMaR process specific to this project:

 

Ø                     April 16, 2024:  WA 2024-40FM was issued to Halfacre Construction Company, through a direct select process, for pre-construction phase (Phase I) services. During this phase, the Contractor evaluated the drawings produced by Pennoni; obtained quotes from applicable contractors; and developed the Guaranteed Maximum Price (GMP).

 

Ø                     July 1, 2024:  Halfacre Construction Company submitted a GMP proposal. This Amendment to Contract No. 2023-17.002 presented for approval is for the construction phase (Phase II) of the process.  

 

The Eleventh Amendment to Construction Manager at Risk Contract No. 2023-17.002 for Construction Services Contract, Phase II with Halfacre Construction Company for repairs at Myakkahatchee Creek Environmental Park has been reviewed by the City Attorney and is legally correct as to form.

Funding in the amount of $318,101.31 is allocated in the Parks & Recreation Department Fiscal Year 2024 budget in Project No. P17EPI, using a blend of both Park Impact Fees and Surtax funding, which is in account numbers 152-3036-572-46-04 and 306-3036-572-63-00.

 

Procurement

 

Contract No. 2023-17.002 was procured pursuant to Sec. 2-406 Professional Services selection under the Consultants Competitive Negotiation Act (CCNA), F.S. § 287.055 of the Code of the City of North Port, Florida.

 

CMAR Process:

 

Ø                     Phase I:  The Contractor is selected and issued a Work Assignment for the pre-construction phase.

 

Ø                     Phase II: The GMP for the construction phase was negotiated for repairs at the Myakkahatchee Creek Environmental Park.
