* Pros: Allows the project to proceed with established terms for water and wastewater service. Ensures equivalent residential connection (ERC) assignments, capacity payments, and infrastructure requirements are clearly documented.
* Cons: Potential community opposition regarding more development and/or specific use of land.
Option 2: Deny the Water and Wastewater Developer's Agreement. by and Between the City of North Port, Florida and North Port RV, LLC.

Background Information
The City of North Port utilizes a Standard Water and Wastewater Developer's Agreement to establish the terms for providing utility service to new developments. In certain cases, site-specific requirements or negotiated terms result in a Non-Standard Agreement, which requires City Commission approval pursuant to the Code of the City of North Port, Florida.
North Port RV, LLC (Solana RV Park) is developing a recreational vehicle park and associated facilities on property within the City's utility service area. The Agreement includes provisions for the design, permitting, and construction of on-site and off-site water and wastewater infrastructure, including lift stations and Supervisory Control and Data Acquisition integration, at the Developer's expense. The Developer will also dedicate necessary easements, transfer ownership of completed facilities to the City, and comply with reclaimed water standards when applicable.
While the overall structure mirrors the City's Standard Agreement, certain terms have been modified to address the project's unique infrastructure layout, phasing, and service needs. This Water and Wastewater Developer's Agreement has been reviewed by the Utilities Department to ensure regulatory compliance and protection of City interests.
The Water and Wastewater Developer's Agreement by and Between the City of North Port, Florida and North Port RV, LLC has been reviewed by the Interim City Attorney and is legally correct as to form.
Approval of this Water and Wastewater Developer's Agreement by the City Commission is required prior to execution and recordation.

Financial Impact
Approval of this Water and Wastewater Developer's Agreement will result in the collection of water and wastewater capacity fees, inspection fees, and other applicable charges in accordance with the City's adopted utility rate structure.
