TITLE: Approve the Thirteenth Amendment to Construction Manager at Risk Contract No. 2023-17.004 for Construction Services Contract, Phase II With Jon F. Swift, Inc. in the Amount of $1,696,898, for Construction of the Circle of Honor.
Recommended Action
Approve the Thirteenth Amendment to Construction Manager at Risk Contract No. 2023-17.004 for Construction Services Contract, Phase II with Jon F. Swift, Inc. in the amount of $1,696,898, for construction of the Circle of Honor.
Background Information
During the City Commission Regular Meeting held on June 28, 2022, discussion took place regarding the selection of a name for the new Veterans Memorial Park followed by review of a park concept plan developed by the Veterans Park Advisory Committee. Subsequent to review and discussion, the following motions were made by the Commission:
Ø Motion One: To approve Circle of Honor as the official name of the Veterans Park.
Ø Motion Two: To direct the City Manager to prepare the necessary documents to move forward to the design phase for the Circle of Honor.
Professional engineering services to support the design phase for this project were awarded to Pennoni & Associates on January 10, 2023, and Work Assignment No.2024-30FM was issued to Jon F. Swift, Inc. for Pre-Construction Phase (Phase I) services.
The Circle of Honor project has reached 100% design and staff is requesting Commission approve the Thirteenth Amendment to Construction Manager at Risk Contract No. 2023-17.004 to facilitate construction. Based on the construction timeline provided, it is estimated that the Circle of Honor project will be completed in late July of 2026.
The Thirteenth Amendment to Construction Manager at Risk Contract No. 2023-17.004 for Construction Services Contract, Phase II with Jon F. Swift, Inc. of the Circle of Honor has been reviewed by the Interim City Attorney and is legally correct as to form.

Funding in the amount of $1,850,000 has been allocated in the Parks & Recreation Department amended Capital Improvement Budget in Project No. P21VET. Design services are now complete and permitting is underway. This project has an available project balance of $1,715,576 in the accounts outlined below:

Procurement
Contract 2023-17-004 was procured pursuant to Sec. 2-406 Professional Services selection under the Consultants Competitive Negotiation Act (CCNA), F.S. § 287.055 of the Code of the City of North Port, Florida.
CMaR Process:
Ø Phase I - The Contractor is selected and issued a Work Assignment for the Pre-Construction Phase.
Ø Phase II - The GMP for the Construction Phase was negotiated for services at the Circle of Honor.
