First Reading:

 

Continue Ordinance No. 2023-34 to second reading on January 23, 2024.

 

Second Reading:

 

Approve and adopt Ordinance No. 2023-34 on second reading.

 

Background Information

 

In an ongoing effort to make the City Code more user friendly, this ordinance will update and clarify portions of Chapter 74, Article IV, in relation to parking.

 

Section 74-84 - Penalties

Repeals and replaces this section of the City Code to clarify the enforcement and applicable penalties for parking violations under the City Code. It increases the time to pay the ticket to thirty (30) days and adds the penalty amounts for violations.

 

Section 74-93 - Tamiami Trail.

Repeals and replaces this section of the City Code to prohibit the parking of certain vehicles on public rights-of-way located in areas zoned residential, commercial, and industrial along Tamiami Trail.  It removes the identification of specific areas along Tamiami Trail.

 

Section 74-92 - Storage of certain vehicles.

Amends this section of the City Code to clarify the vehicles prohibited from being parked for storage purposes on public rights-of-way located in areas zoned for residential, commercial, and industrial use.  A definition for “parked for storage purposes” as it applies to this section has also been added.

 

Section 74-94 - Parking spaces for disabled persons.

Amends this section of the City Code as it relates to parking vehicles in parking spaces designated and marked for disabled persons. It more closely restates Florida Statute section 316.1955(1).

 

Appendix A, Section F

Amends this section of the City Code to remove the fines for parking ticket violations. The applicable penalties are added to City Code Section 74-84.

 

 

This ordinance repeals, replaces and amends portions of the City Code. It has been reviewed by the City Attorney and is legally correct as to form.

At its regular meeting on December 12, 2023, the City Commission continued this ordinance to second reading on January 23, 2024, as presented.

In accordance with Florida Statute Section 166.041, a business impact estimate was prepared and posted publicly on the City’s website on November 28, 2023.

 

Notice of the proposed ordinance was published on December 15, 2023 in a newspaper of general circulation in the City of North Port.
