Recommended Action

 

The City Commission approve Petition No. PLF-22-121 Solstice Phase 1 Replat.

 

General Information

 

Brian O’Hara of Toll Southeast Company, Inc. requests review and approval of a final plat to move lot lines for lots 166-176 to accommodate as-built alignment of sewer line between MH 19 and existing MH 1F-6. The lot line between lots 71 and 72 is also being adjusted to provide an easement sized to accommodate the installed utility pipe on lot 71 within Solstice Phase 1 Replat.

 

In December of 2020, the Infrastructure (INF-20-120) and Subdivision Plans (SCP-20-121) for Solstice Phase 1 were approved by City Staff. Revisions to the approved Infrastructure (REV-21-087) and Subdivision Plans (REV-21-086) were approved by City Staff in May 2021. The plat also included the associated roadway, stormwater, utility tracts and easements. The site contains approximately ± 115.80 acres.

 

A surety bond for INF-20-120 in the amount of $1,323,203.00 has been received by the City of North Port. Prior to the as built being submitted, the applicant was aware of new sewer line installed that encroached outside of the allotted easement. To keep the side lots consistent, the applicant decided to shift the lot lines between lots 166-176.

 

In June of 2022, an application for this replat was submitted to the Planning & Zoning Division to match the as-built plans consistent with the conditions on site. The lot lines for lots 166-176 have been moved over, adjusting the alignment of sewer line between MH 19 and the existing MH 1F-6, and lot lines between lots 71 and 72 were adjusted to allow product on lot 71. Other than these three changes this proposed plat includes the same type and number of units.

 

The West Villages Improvement District (WVID) has reviewed and approved the plat. Furthermore, the WVID has consented to changes mentioned above.

 

On September 15, 2022, The Planning and Zoning Advisory Board recommended approval to the Commission of Petition No. PLF-22-121, as presented, and find that, based on the competent substantial evidence, the Plat complies with all regulations set forth in the Comprehensive Plan, the Unified Land Development Code (ULDC) and Florida Statutes Chapter 177.
