TITLE: A Resolution of the City of North Port, Florida, Approving the Expenditure of $159,606.00 in Forfeiture Funds; Providing for Incorporation of Recitals; Providing for Conflicts; Providing for Severability; and Providing an Effective Date.
Recommended Action
Approve Resolution No. 2025-R-37 as presented.
Background Information
The City of North Port seized funds acquired during the fiscal year from October 1, 2023 through September 30, 2024, in accordance with the Florida Contraband Forfeiture Act.
Pursuant to Florida Statute §932.7055(5)(c)(3), any law enforcement agency that acquires at least fifteen thousand dollars ($15,000.00) under the Florida Contraband Forfeiture Act within a fiscal year must expend or donate no less than twenty-five percent (25%) of the proceeds for the support or operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe neighborhood, or school resource officer program or programs. The local law enforcement agency has the discretion to determine which program or programs will receive the designated proceeds.
To meet the statutory requirement, the North Port Police Department proposes expanding and/or donating forty-one thousand dollars ($41,000.00) as follows.
Safe Neighborhood/Crime Prevention/National Night Out (Community Shirts) $20,000.00
Florida FBI National Academy Associates, Inc. (FBINAA) (Cash Donation) $ 2,000.00
National Association for the Advancement of Colored People (NAACP) (Cash Donation) $ 2,500.00
Teen Court of Sarasota (Cash Donation) $ 5,000.00
Drug Free Youth (D-Fy) (Cash Donation) $ 2,000.00
Child Protection Services (Cash Donation) $ 5,000.00
Sarasota Coalition on Substance Abuse (Cash Donation) $ 1,500.00
Mothers Against Drunk Driving (MADD) (Cash Donation) $ 1,500.00
Imagine at North Port Young Marines (Cash Donation) $ 1,500.00
In compliance with Florida Statute §932.7055(5)(a), the remaining one hundred eighteen thousand six hundred six dollars ($118,606.00) will be used for new and additional law enforcement equipment and will not be used to meet normal operating expenses of the North Port Police Department.
Resolution No. 2025-R-37 is contingent upon the passage of Ordinance No. 2025-18.
Resolution No. 2025-R-37 has been reviewed by the Interim City Attorney and is legally correct as to form.
