TITLE:                     Discussion and Possible Action Regarding Art Fund Contributions Required for New Development per Section 59-5 of the City of North Port Unified Land Development Code.

 

 

Recommended Action

 

Discussion and possible action regarding the Art Fund contributions required for new development per Section 59-5 of the City’s Unified Land Development Code (ULDC).

 

Background Information

 

Section 59-5 of the City’s Unified Land Development Code establishes requirements for the City’s Public Art Contribution Program.  The code specifically requires that new developments provide public art or public works of art on the development site or contribute to the City’s Public Art Account.  The value of said art or contribution to the Public Art Fund is an amount equal to one-half (1/2) of one percent (1%) of the first $50,000,000 in construction costs up to a maximum contribution amount of $250,000.

 

During the City Commission Regular Meeting on December 8, 2020, the Commission discussed the Art Fund Contributions under Section 59-5 of the ULDC and voted to:

 

Adjust the art fund fee for the collection from developments with activity centers using Scenario 2B, 40 cents per square-foot for construction, capping it at $150,000, to be input into the Unified Land Development Code.

 

Staff’s plan is to incorporate this change into the ULDC Rewrite.  As such, since this change not yet been included in an Ordinance adopted by the Commission, developers are still subject to the contribution of half of one percent of construction costs up to $250,000. Commissioner Luke is requesting discussion by the Commission to decide whether the change should be expedited, rather than wait for the completion of the ULDC Rewrite.

Staff will conduct a financial impact analysis regarding the changes to developers’ contributions to the Art Fund which will be included in the staff summary for the adoption of either the ULDC Rewrite or a separate Ordinance as deemed appropriate by the Commission.
