TITLE: Approve Petition No. PLF-20-100, Plat of Wellen Park Downtown Phase 1 (QUASI-JUDICIAL)
Recommended Action
Approve PLF-20-100, Wellen Park Downtown, Phase 1, Plat with the following conditions:
1. Recording of the consent to terminate two force main easements recorded on instrument ORI 2007158249 and ORI 2007158250 and retain the lift station easement ORI 2007158246 and Ingress/Egress Easement ORI 2007158251 prior to the recording of the plat (GEN-20-162);
2. Subject to approval of the consent to terminate above said easements by the City Commission.
Background Information
John Luczynski, Senior Vice President of Wellen Park LLLP, on behalf of Main Street Ranchlands LLLP, is requesting review and approval of a final plat for 11 commercial lots with associated road right-of-way, drainage, and utility easements within Wellen Park, Phase 1. The Plat has been reviewed and approved by the City Surveyor. The total site contains approximately ±127.37 acres (Staff noticed a scriveners error in the staff report regarding acreage. The staff summary sheet reflects the correct acreage).
Petition No. PLF-20-100, Wellen Park Downtown, Phase 1, Plat is consistent with the associated Subdivision (SCP-20-050) and Infrastructure Plans (INF-20-051), previously approved by City staff. The Plat meets the requirements of the Comprehensive Plan, Unified Land Development Code (ULDC) Chapter 37, Florida Statutes Chapter 177, and is consistent with the West Villages District Pattern Plan (VDPP) for Village D and the subdivision/infrastructure approvals.
A surety Bond for INF-20-051 in the amount of $1,113,662.00 has been received by the City of North Port.
It should be noted on the front page of the plat the proposed dedication language for transfer of land is consistent with the legislative requirements for the District. Typically, the transfer of land has been presented to Commission as a separate agenda item. In this case the transfer language is included in the plat dedication and the transfer will occur upon recording of the plat.
At its regular meeting on October 1, 2020 the City of North Port Planning and Zoning Advisory Board unanimously (7-0) recommended approval of PLF-20-100, Wellen Park Downtown, Phase 1, Plat with the following conditions:
1. Recording of the consent to terminate two force main easements recorded on instrument ORI 2007158249 and ORI 2007158250 and retain the lift station easement ORI 2007158246 and Ingress/Egress Easement ORI 2007158251 prior to the recording of the plat (GEN-20-162);
2. Subject to approval of the consent to terminate above said easements by the City Commission.
