TITLE:      Ordinance No. 2015-10, second reading, Petition No. GEN-15-019, Amending the North Port City Code Article II, Florida Building Code, Section 14-20. Adoption of standards by reference, repealing in its entirety North Port City code Chapter 14 Building and Construction Regulations, Article III, Contractor Certification and Examination.
 
 
Recommended Action
 
Approve Ordinance No. 2015-10 for adoption.
 
Background Information
 
The petition was advertised in a newspaper of general circulation within the City of North Port on March 10, 2015, pursuant to the provisions of Section 166.041(3)(a), Florida Statutes and Section 9.01(b) of the Charter of the City of North Port.
 
The City Attorney has reviewed Ordinance No. 2015-10 and the Chapter 1, Administrative Code for the Florida Building Code and has approved as to form and correctness.
 
As part of a City Commission Workshop held on April 15, 2014, staff presented an overview of proposed amendments to Chapter 14 Article II including repealing Article III of the North Port City Code in its entirety.
 
Changes to Chapter 14 Article II
•      Sec. 14-20 - Adoption of standards by reference
•      Removes the edition number (code date)
•      Replaces "Florida Legislature" with "Florida Building Commission"
•      Adopts a modified Chapter 1 - Administrative Code
•      Deletes parts (b) through (g)
 
Changes to Chapter 14 Article III:
•      Repeal of Article III in its entirety
•      Relocate essential text to Chapter 1 - Administrative Code for the Florida Building Code
 
Staff also presented amendments to update Chapter 1, Administrative Code for the Florida Building Code and include legislative changes as part of this update. These modifications are incorporated into the following sections:
 
•      Unsafe Building Regulations - Sections 101, 102, 104, 109 and 115
•      Contractor Regulations - Sections 104.14, 105.1, 109.7, 109.8
•      Flood Regulations - Sections 104.10, 107.6.1, 117
•      Permits - Section 105.1
•      Violations - Section 113
•      Appeals - Section 116
•      Severability - Section 118
 
 
At the direction of Commission during the workshop staff has incorporated the changes as discussed into Ordinance No. 2015-10 and Chapter 1, Administrative Code for the Florida Building Code. Additions are shown in underline and deletions in strikethrough format.
 
At its regularly scheduled meeting of March 23, 2015, the City Commission voted 5-0 to approve Ordinance No. 2015-10, Petition No. GEN-15-019 to second reading.

The text amendments proposed at this time, ties in with the Service Consolidations/Efficiencies priority of the City's Strategic Plan.
