Recommended Action

 

Approve Resolution No. 2023-R-11, A Resolution of the City Commission of the City of North Port, Florida, Accepting the Transfer of Certain Sanitary Sewer Lift Station and Wastewater Infrastructure Improvements and Associated Warranties in Village F and Village G of Wellen Park; Providing for Filing of Documents; Providing for Conflicts; Providing for Severability; and Providing an Effective Date.

 

Background Information

 

The 2019 Amended and Restated Utilities Agreement between the City and West Villages Improvement District (WVID) and West Villages, LLLP, required that WVID construct a wastewater treatment plant and convey the plant, land, and lift stations along with all warranties to the city. The City Commission accepted the conveyance of the wastewater treatment plant and existing lift stations via Resolution 2020-R-07 on March 25, 2020. To comply with the agreement, WVID desires to convey lift stations 1F, 2F, 3F, and 4F and provide the necessary easement to lift station 4F for operation and maintenance purposes.

 

Typically these easements would be recorded with the plat; however, the location of the lift stations was not identified prior to the development of this area, therefore necessitating acceptance by this resolution.

 

Resolution No. 2023-R-11 has been reviewed by the City Attorney and is legally correct as to form.
