TITLE: Approve the Second Amendment to Construction Manager at Risk Contract No. 2023-07 for Construction Phase Services, Phase II, With Wharton Smith, Inc. for the Demolition and Construction of Fire Station 81, Increasing the Agreement Fees by $15,507,229.00 for a New Total Amount of $15,674,884.92.
Recommended Action
Approve the Second Amendment to Contract No. 2023-07, Construction Manager at Risk for Construction Phase Services, Phase II, with Wharton Smith, Inc. for the Demolition and Construction of Fire Station 81, increasing the Agreement fees by $15,507,229.00 for a new total amount of $15,674,884.92.
Background Information
The following provides a chronological order of events regarding the remodeling, demolition, installation of a temporary fire station and construction of a new, storm-hardened Fire Station 81:
Ø April 25, 2023: During the City Commission Regular Meeting, the Commission approved Contract 2023-07 with Wharton Smith, Inc., for Construction Manager at Risk Contract Preconstruction Services Contract, Phase I in the amount of $42,340.09 for the Remodel of Fire Station 81. The initial plan for this project was to add square footage to meet the need of the growing administration as well as remodel and update an aging fire station.
Ø September 2022: Hurricane Ian made landfall and significant damages were sustained to Fire Station 81. The repairs needed as well as the previous expansion and remodel plans exceeded the National Flood Insurance Program 50% rule administered by the Federal Emergency Agency (FEMA), requiring the fire station to be upgraded to current building codes and proper hardening as a Florida Building Code Essential Facility.
Ø June 11, 2024: During the City Commission Regular Meeting, the Commission approved the First Amendment to Contract 2023-07 to update the existing Agreement with Wharton Smith Inc., to include professional services required to replace Fire Station 81 with a code updated building, and to include a temporary fire station to serve during the construction phase, increasing the cost by $125,315.83.
The Second Amendment to Contract No. 2023-07, Construction Manager at Risk for Construction Phase Services, Phase II, with Wharton Smith, Inc. updates the current Agreement with Wharton Smith, Inc. for Construction Phase Services to demolish the existing Fire Station 81, complete installation of a temporary fire station and construct a new, storm-hardened Fire Station 81.
The Second Amendment to Contract No. 2023-07, Construction Manager at Risk for Construction Phase Services, Phase II, with Wharton Smith, Inc. for the Demolition and Construction of Fire Station 81 has been reviewed by the Interim City Attorney and is legally correct as to form.
