Option 1: Approve the Termination of the Assignment and Assumption of Master Service Agreement and Statement of Work between the City of North Port, Florida, and CivicPlus, LLC, in the amount of $26,029.50, approved by the City Commission on February 28, 2023.
 
•                     Pros:   The termination of this Agreement will result in an annual cost savings of $26,029.50 for the City. In place of the previous solution, the Information Technology Division staff has developed an internal application, North RePort that effectively captures citizen input, replicating the functionality an application, See ClickFix, previously provided by Civic Plus.
 
•                     Cons:  Staff has not identified a con to denying the termination of this Agreement.
 
Option 2: Deny the Termination of the Assignment and Assumption of Master Service Agreement and Statement of Work between the City of North Port, Florida, and CivicPlus, LLC, in the amount of $26,029.50, approved by the City Commission on February 28, 2023.
 
•     Pros: Staff has not identified an advantage to denying the termination of this Agreement.
 
•     Cons: The City would continue to incur an annual cost of $26,029.50 for an application that has already been internally developed and is currently operational at no additional cost to the City.
 
Background Information
 
The following provides a chronological order of events pertinent to the termination of the Agreement between the City of North Port, Florida, and CivicPlus:
 
Ø                     February 28, 2023:  During the City Commission Regular Meeting, the Commission approved the  Assignment and Assumption of Master Service Agreement and Statement of Work between the City of North Port, Florida, and CivicPlus, LLC, in the amount of $26,029.50.
 
Ø                     June 2023:  Civic Plus notified the City that the renewal cost for their services would increase by 16%. Despite efforts to negotiate, the vendor was unwilling to adjust the increase to a more typical range of 3-5%, which the City has historically experienced.
 
Ø                     June 2023:  The Information Technology Division was in the process of developing an internal application, North RePort to replace CivicPlus SeeClickFix. Given the significant cost increase and the progress of the in-house solution, the Information Technology Division informed CivicPlus that  in accordance with the terms of the Agreement, the City would not be renewing their Agreement for the SeeClickFix application.  
 
Ø                     October 1, 2024:  The City officially launched an internally developed application, North RePort, that replicates the core functionality of SeeClickFix previously provided by Civic Plus. 
 
Please note that pursuant to the provisions of the City Charter, City Commission approval is required to approve as well as terminate Contracts and Agreements. Although the Information and Technology Division staff notified CivicPlus in June 2023 that they would not be renewing the Agreement for the SeeClickFix application, formal City Commission approval to terminate this Agreement is still necessary. 
 
The Termination Letter for CivicPlus has been reviewed by the City Attorney and is legally correct as to form.
 
The Termination Letter for CivicPlus will be provided to the City Clerk’s Office prior to the City Commission  Regular Meeting on November 4, 2025,  for signature, subject to City Commission approval.
