TITLE:                     Approve the Federal Bureau of Investigation (FBI) National Vehicle Lease, Vehicle Use Agreement - Non-FBI Task Force Officer, at no Cost to the City of North Port.

 

 

Recommended Action

 

Approve the Federal Bureau of Investigation (FBI) National Vehicle Lease, Vehicle Use Agreement - Non-FBI Task Force Officer, at no cost to the City of North Port.

 

Background Information

 

The North Port Police Department has a Task Force Officer (Operator) assigned to the FBI Child Exploitation and Human Trafficking Task Force (CEHTTF).  As a member of the Task Force, the FBI may provide a vehicle to the Operator for performance of duties assigned under the Task Force Program.  This Agreement is required for the Task Force Officer to obtain and use the vehicle.

 

The following summarizes the highlights of the 2024 FBI Vehicle Use Agreement:

 

Ø                     The terms and conditions of the 2024 FBI Vehicle Use Agreement will remain the same as the 2019 FBI Vehicle Use Agreement.

 

Ø                     The restrictions and responsibilities of the Operator’s use of the vehicle are outlined.

 

Ø                     Includes provisions that the City could be held accountable if the vehicle is not returned to the FBI in the same condition as received, except for normal wear and tear, and it does not alter the potential liability of the Operator, City or the United States.   

 

Ø                     The 2024 FBI Vehicle Use Agreement will supersede the 2019 Vehicle Use Agreement.

 

Ø                     The 2024 FBI Vehicle Use Agreement will coincide with the CEHTTF Memorandum of Understanding.

 

Ø                     The 2024 FBI Vehicle Use Agreement will remain in effect until the earliest occurrence of the following:

 

ü                     Conclusion of the Operator’s assignment on the Task Force.

ü                     Conclusion of the FBI’s participation in the National Vehicle Lease Program; or

ü                     Termination by written notice of one party to the other.

 

The FBI National Vehicle Lease, Vehicle Use Agreement - Non-FBI Task Force Officer, at no cost to the City of North Port has been reviewed by the City Attorney and is legally correct as to form.
