TITLE: Approve the Memorandum of Understanding (MOU) for Access to Biometric Facial Analysis System with the Florida Department of Highway Safety and Motor Vehicles
Recommended Action
Approve the Memorandum of Understanding (MOU) between the City of North Port and the Florida Department of Highway Safety and Motor Vehicles.
Background Information
The North Port Police Department is a current user of Pinellas County Sheriff’s Office’s (PCSO) Face Analysis, Comparison, and Examination System (“FACES”), which also allows access to Florida driver license and identification card photographs, which are collected and maintained by the Department. The PCSO has executed the enclosed MOU as the Requesting Party (a defined term in the MOU) with the understanding that each agency that has access to FACES will now be required to execute the MOU with the Department as a Third Party End User (a defined term in the MOU) in order to continue to have access to Florida driver license and identification card photographs.
The enclosed MOU addresses requirements for monitoring of records, proper use of the system, safeguarding information, and compliance and control measures. The MOU requires the Third Party End User to self-report violations of the MOU to the Department within thirty (30) days of discovery, complete a Quarterly Quality Control Review Report, submit an annual Certification Statement to the Department, and notify the Department in writing of any misuse of the system within thirty (30) days of discovery.
The agreement has been reviewed by legal and is approved as to form and correctness.
