Recommended Action
Approve Amendment No. 2 to Work Assignment 2022-18PW.01 for Assistance with Federal Emergency Agency (FEMA) Reimbursement and Other Grants Management Services after Hurricane Ian with Rostan Solutions, LLC., for an additional amount of $1,000,000, for a total cost of $4,000,000.
Background Information
The following provides a chronological order of events regarding Amendment No. 2 to Work Assignment 2022-18PW.01:
Ø October 7, 2022: The City Manager executed emergency authority granted under Ordinance 2022-30 and approved Work Assignment 2022-18PW.01 for Assistance with FEMA Reimbursement and Other Grants Management Services after Hurricane Ian in the amount of $500,000.00 with a final completion date of April 5, 2023.
Ø November 21, 2022: The City Manager approved Change Order No. 1 to Work Assignment 2022-18PW.01 for Assistance with FEMA Reimbursement and Other Grants Management Services after Hurricane Ian for an additional amount of $1,000,000, for a total cost of $1,500,000.
Ø April 11, 2023: The City Manager approved Change Order No. 2 to Work Assignment 2022-18PW.01 for Assistance with FEMA Reimbursement and Other Grants Management Services after Hurricane Ian for additional time of 785 days, bringing the completion date to May 29, 2025.
Ø September 26, 2023: During the Road and Drainage District Governing Body Meeting, the City Commission approved Amendment No. 1 to Work Assignment 2022-18PW.01 for Assistance with FEMA Reimbursement and Other Grants Management Services after Hurricane Ian for an additional amount of $1,500,000, for a total cost of $3,000,000.
Ø May 2024: Rostan Solutions, LLC completed a periodic evaluation of the complexity, count and status of the Hurricane Ian claims still pending with FEMA and the management activities that will be required to complete this project. On May 23, 2024, Rostan Solutions, LLC provided a revised estimate which increased the projected total to $4,000,000 from the previous estimate of $3,000,000. The Department of Public Works is requesting an amendment to increase the Rostan Solutions, LLC work assignment in the amount of $1,000,000 based upon the updated estimate for remaining services.

Financial Impact
Funds have been allocated in the Fiscal Year 2024 Road and Drainage District Budget, account no. 107-5000-541.34-00, Project No. IAN22. Road and Drainage District account 107-0000-331.50-02 will be reimbursed when the FEMA reimbursement is received.
The Road and Drainage District has received reimbursement of $1,730,216.98 to date for the services related to Financial Recovery Assistance Services.
Procurement
Emergency standby Agreement No. 2019.49-01 was procured pursuant to Section 2-405 of the Competitive Sealed Proposal Process of the Procurement Code. Work Assignment 2022-18PW.01 was issued as a Notice to Proceed (NTP) authorized under Section 2-408 Emergency Procurement with the activation of Ordinance No. 2022-30 on September 26, 2022. Work Assignment No. 2022-18PW.01 has been and will be issued respectively under Agreement No. 2019-49.01, utilizing the hourly rates contained in the agreement.
