TITLE:                     Approve the Sixteenth Amendment to Construction Manager at Risk Contract No. 2023-17.002 for Construction Services Contract, Phase II With Halfacre Construction Company in the Amount of $35,868.68, for Hurricane Ian Repairs at LaBrea Park.

 

 

Recommended Action

 

Approve the Sixteenth Amendment to Construction Manager at Risk Contract No. 2023-17.002 for Construction Services Contract, Phase II with Halfacre Construction Company in the amount of $35,868.68, for Hurricane Ian Repairs at LaBrea Park.

 

Background Information

 

As a result of impacts from Hurricane Ian, LaBrea Park suffered damage to the site fencing, signage, playground equipment, shade canopies, and trash receptacles as outlined in the Halliwell Construction Services and Rostan Damage Assessment Report. While initial repairs were underway at LaBrea Park, Halfacre Construction Company and City staff discovered that the two (2) shade structures had sustained structural damage beyond the repairs assumed in the GMP allowance outlined in the Fifth Amendment to contract 2023-17.002. In order to return the park to its pre-hurricane condition, both shade structures require full replacement.

 

In consultation with City Administration, the use of the Construction Manager at Risk (CMaR) Continuing Services Contract has been identified as the most expedient path to complete this project. The following describes the CMaR process specific to this project:

 

Ø                     September 24, 2024:  Fifth Amendment to Contract No. 2023-17.002 encompassing Work Assignment No. 2024-06FM was issued to Halfacre Construction Company for Pre-Construction Phase (Phase I) services. During this phase, the Contractor evaluated the work required, obtained quotes from applicable contractors, and developed the Guaranteed Maximum Price (GMP).

 

Ø                     February 7, 2025:  Halfacre Construction Company submitted a GMP for additional services outside the initial damages outlined in the Fifth Amendment. The Project Manager with the Department of Public Works provided a direct selection of Halfacre Construction Company as the preferred CMaR to carry out the project at LaBrea Park and requests approval of this Amendment to proceed to construction. 

 

The Sixteenth Amendment to Construction Manager at Risk Contract No. 2023-17.002 for Construction Services Contract, Phase II with Halfacre Construction Company for Hurricane Ian repairs at LaBrea Park has been reviewed by the Interim City Attorney and is legally correct as to form.

Funding in the amount of $35,868.68 is available in the Parks & Recreation Department budget in Project No. IAN22, account number 001-3038-572-46-03.

 

Procurement

 

Contract No. 2023-17.002 was procured pursuant to Sec. 2-406 Professional Services selection under the Consultants Competitive Negotiation Act (CCNA), F.S. § 287.055 of the Code of the City of North Port, Florida.

 

CMAR Process:

 

Ø                     Phase I:  The Contractor is selected and issued a Work Assignment for the Pre-Construction Phase.

 

Ø                     Phase II: The GMP for the Construction Phase was negotiated for Hurricane Ian repairs at LaBrea Park.
