Background Information
The former playground equipment at Butler Park was installed in 2011 in conjunction with the construction of the Morgan Family Community Center and removed in 2018 to allow for construction of the North Port Aquatic Center. Project P19BPR, which was approved with the Capital Improvement Plan for FY18/19 and funded through a Surtax III allocation, provides for the replacement of the playground equipment and relocation of the playground to an area adjacent to the new Aquatic Center parking lot.
In an effort to have the playground installation coincide with the opening of the Aquatic Center, the original Request for Proposal (RFP No. 2019-53) for the playground replacement was advertised on February 12, 2019 with responses due on March 15, 2019. Eight bidders were reviewed and ranked by the selection committee. In early April, Purchasing was made aware of a potential protest to the rankings based on contractor licensing. Purchasing requested legal review and it was determined that additional clarification was needed related to contractor licensing requirements and the best course of action was to reject all proposals and re-advertise with an updated solicitation. The City posted a Notice of Intent to Reject and Reissue RFP 2019-53 on May 15. Staff then worked with Purchasing and the Building Official to clarify the requirements in the RFP language regarding contractor licensing.
A second Request for Proposal (RFP 2020-06) was advertised on July 19, 2019 with proposals due on August 20. Two responsive proposals were received, evaluated and ranked by the selection committee. The selection committee recommended, and the City Manager supported, to accept the proposal submitted by Advanced Recreational Concepts, LLC (ARC). The Committee held further pre-award discussions with ARC to finalize colors, patterns, and textures associated with the equipment. The final orientation of equipment on site, will be coordinated with the City project manager once all equipment is delivered.
The playground proposed by ARC features an Aquatics theme to correspond with the North Port Aquatic Center and includes a dedicated play structure for children ages 2 to 5; a dedicated play structure for children ages 5 to 12; a multi-user basket swing; an interactive face to face swing; an ADA compliant swing, and standard swings; a ride on fish rocker; a multi-user climbing dome; and playground seating. Both play structures will be covered with a single freestanding shade canopy.
ARC, per the terms of their proposal, identified that the playground equipment will be delivered and installed within 90 days of the City issuing the Notice to Proceed (NTP). A pre-construction meeting is tentatively scheduled for December 5, and at that time the NTP date and final project timeline will be determined.

Financial Impact
Project #P19BPR, Butler Playground Equipment was approved as part of the FY18/19 Capital Improvement Program and is budgeted using a Surtax III allocation (306-3036-572-63-00) of $200,000. Funding for this project will be rolled over from FY18/19 to FY19/20.
