Recommended Action

 

Approve Amendment No. 5 to Agreement No. 2005-05 between the City of North Port and TGW Engineering, Inc. to provide construction engineering services for the Myakkahatchee Creek Greenway Nature Trail in the amount of $47,671, for a total contract amount of $318,157, and authorize a contingency amount of up to $4,000.

                     

Background Information

 

The following provides a chronological order of events regarding the Myakkahatchee Creek Greenway Nature Trail Project:

 

Ø                     July 25, 2005:  The City Commission approved Agreement No. 2005-05 with TGW Engineering, Inc. to develop the Myakkahatchee Creek Greenway Master Plan.

 

Ø                     December 10, 2007:  During the City Commission Regular Meeting, the Commission adopted the Myakkahatchee Creek Greenway Master Plan, as presented, with funding to be appropriated at a future time.

 

Ø                     July 27, 2009: During the City Commission Regular Meeting, the Commission approved Amendment No. 1 to Agreement No. 2005-05 with TGW Engineering, Inc. to design the Myakkahatchee Creek Greenway Nature Trail. The following provides a timeline for the Approval of Agreement No. 2005-05 and subsequent Amendment Nos. 1, 2, 3 and 4:

Update Construction documents

 

Ø                     June 28, 2022: Request for Bid 2022-23 was awarded for construction services of the Myakkahatchee Creek Greenway Nature Trail to Gale Construction Company of Illinois in the amount of $1,908,812. As part of the Pre-Construction meeting, it was identified that engineering construction services were not included as part of any previous amendments. Amendment No. 5 allows for the Engineer of Record to review all contractor submittals, onsite observation of work, trail modifications to mitigate wildlife impacts, attend project meetings, provide responses to contractor inquiries and prepare the close out and as-built documents.

 

Amendment No. 5 to Agreement No. 2005-05 between the City of North Port and TGW Engineering, Inc. to provide construction engineering services for the Myakkahatchee Creek Greenway Nature Trail has been reviewed by the City Attorney and is legally correct as to form.

Financial Impact

 

Project P10MCG, Myakkahatchee Creek Greenway Nature Trail, is funded at $2,111,786 utilizing a blend of Surtax allocations, Parks & Recreation Impact Fees, and a developer contribution of $141,646.

 

A contingency of $133,000 for Project No. P10MCG was approved on June 28, 2022, along with the construction agreement for Gale Construction Company of Illinois. To offset the $47,671 expense of Amendment No. 5 the project will utilize a portion of the existing contingency leaving a balance of $85,329.
